Fingerprint On Proof Set?

[Please bear with me, new to the whole numismatic thing]

I won a 2002 Silver Proof Set on the 'Bay. It shows up and there is clearly a fingerprint on the half dollar.

I got in touch with the seller and "they never touched it", and think I should submit an insurance claim to USPS!?

I'm going to try to just get a new half to replace this one (I didn't even know these sets were not sealed.) and throw the other one into my bullion stack provided the seller (who has 2000+ 100% feedback) doesn't offer a better solution.

Should I neg the seller or is it entirely possible they did not notice and this was a problem from the mint? It's pretty obvious and makes the coin look terrible. The rest appear fine to my untrained eyes.

Return shipping for one coin would be wasteful (and more costly) considering the cost of a replacement - bullion value of damaged coin would just be a few bucks.

Am I missing another avenue of recourse?

These sets were sealed at the mint but are not difficult to open. I'd return the set for a refund.

No way the USPS is liable here and the seller suggesting such a thing is ludicrous.

Just the proof 2002 silver half is worth $10. Do not neg the seller because they likely didn't notice. You can always return the item at your expense for a refund and that's what I would tell the seller.

Thanks for the advice.

The seller did offer to accept a return for refund, so that at least eases my concerns that he wasn't trying to pull a fast one.

I do think I'll try opening the case and replacing it with a good coin after I pick up a new one. For the hassle & cost to return & the fact that this will make an interesting coin in my bullion stack, it's just not worth it to me.

I trust these cases aren't that hard to crack open? Anything I should be careful of (besides fingerprinting up the other coins...)

someone that sold the set to the dealer may have swapped the coin in the set before selling it to the dealer you bought it from. I have heard allot of people taking out coins they thought may grade PF-70 and replacing it with a lesser quality coin (PF-69 coin) in hopes they score big from the TPG. Another concern would be, did they replace it with a silver half or just a clad half, this would be difficult to tell without opening the case again and removing the coin. If it has already been taken apart once it shouldn't be hard to do so again and since there is a finger print on one of he coins chances of it being taken apart are very high
