I purchased this auction last month http://cgi.ebay.com/ws/eBayISAPI.dl...MEWN:IT&rd=1I have been emailing the seller asking if he had a ship date . I emailed him 4 times so far. All I get is no date yet, no explaination. So today I go on ebay and look at his feedback and found this http://cgi.ebay.com/ws/eBayISAPI.dl...m=3965713517So I sent him this email Dear maja.maja, Mark, I hate to be a royal pain. but I bought these for friends and some for myself and resale. all I ask for is a date I can get them. I look on ebay and see you selling rolls of proofs and then this auction http://cgi.ebay.com/ws/eBayISAPI.dl...5712805&rd=1 Please advise if I am getting these or not. and If so when and if not when can I get a refund. I would rather have the coins but this is getting a bit much Thanks, Gil What do you think?. He can't send my shipment that I paid w/paypal right away but he can sell rolls !!!! If I did not hear back relatively quickly, I would first contact PayPal, then ebay, and lastly leave a very clear and concise negative feedback. After looking at the feedback of this seller it looks as if you are not the first. http://www.toolhaus.org/cgi-bin/neg...=Received+by

That Toolhaus site is the absolute best ebay tool. http://www.toolhaus.org/cgi-bin/negsUse it and read very carefully. While many people are afraid to leave negative feedbacks for powersellers, it can still tell a lot about the seller or buyer.

I was defrauded once on ebay US for 60 BU silver eagles The guy had 600 good feedbacks Then he defrauded god knows how many 14 filed IFCC and these complaints were forwarded to det Coco of Pawcatuck police One Texan went to small claims court and got his money back The only negative indicator was long delivery delays ( The guy sold silver he did not have and then bought the coins with the money he received and shipped them . He defaulted when the price of silver shot up because he sold several monster boxes full he did not have )

A lot of dealers and sellers use this practice. I see so many offering the Mint Sets, Proof sets, Commems, Eagles, and various others just because they placed an order with the mint. Many of these coins and sets start fetching good money on ebay and other auctions because the Mint has sold out. Well then the orders are backordered, or not shipped at all. The seller has your money, no coins to ship, and continues to receive more and more from other customers. I know that ebay is easy, and sometimes a little cheaper, but for what it is worth, find a good dealer, build a relationship with them, and pay the couple extra dollars to make sure you get what you pay for.

Filing a complaint with PayPal is your BEST option! They will contact him and then LOCK his account immediately. That lock will last throughout the complaint if it is not settled. The dispute will then go through something similar to a complaint board, which will take up to six weeks, and the account will remain LOCKED until that board makes a decision. I know, as I have been there! Your money is locked up and any new money that arrives thru PayPal is automatically locked up and basically confiscated by PayPal to settle the dispute in the event the seller won't comply to the agreement! My dispute was just the opposite as a buyer attempted to claim the package, which had to be signed for, was not delievered and that he had moved to another city. While I won the dispute my money and account were locked down for over a month. Filing a complaint with PayPal can make this seller miserable very quickly. Good luck and let us know how things work out.

Get this I just got an email from him saying he is wating for the D mint to arrive. so I answered Just send the proofs and you can send the p&d's later. he responded I could either wait a few more days or I can pay the shipping for the nickles. I asked how much shipping would be for 20 reg business strike nickles and he said $2.00. I told him I would wait.

Hi Grovey. Just a little food for thought. Paypal specifies that a seller MUST ship within 7 days of payment received. If you apply to Paypal, you will get your money back with very little hassle. Also, federal law states that a seller must ship within 30 days from payment received. I have seen pre-sales on ebay and they have been described as such and still they must adhere to the Paypal rules if they accept Paypal and the federal regulations.

It burns me that some sellers take their sweet *** time to ship your product you have one/purchased. I think a lot of it is pure laziness to get things to the post office.

Interesting, I considered bidding on this guys stuff on a few occasions, watching yawl wait for stuff purchased has now soured any future biz I will have with this dude, especially after reading his feedbacks--I hate sellers who retaliate when their negative is deserved...

I emailed him again to ask what had happened to the order. The note I sent was very nice however it was on legal letterhead (don't ask). I also reminded him that he may be in violation of PayPal and ebay regulations. The first note I got back rambled on about how he had not yet received the stock and I could get my money back. Then he proceeded to send about two pages of ebay rules staing that he does lots of pre sales and everything he did was legal. I think he must have re-read my memo later in the day because I received a second memo very hotly worded telling me he is in no violations of any policies and I could get my money back and he proceeded to send about four more pages of ebay documents. I think his tone of voice in his emails melted my speakers and monitor. I will complete this order and put him on a watch list.

That's because ebay, per se, does not have any policies regarding this. Paypal does and the federal regulations regarding mail order are in effect for ebay purchases.
