Is this MS? I know its only 5 bucks BU, but I am going to start a 7070. this was in the family so I would like to use it, but is it MS?

I would say no. Luster is absent and I
see some darker color in the fields that looks like the result of circulation. No reason why you can't still put it in your album!

the coin looks like it is getting some nice toning in person but turns out brown on the scanner..how does toning effect value and why is it desirable?
i have a few more( also from the family), how do these look? It doesn't need to be ms, but it would be nice to do the cheaper coins in as good of condition as possible. I would like to start the 7070 to build and trade up each coin as I get older.

Not all toning is desirable and it can either make the coin's value stay the same, rocket upward, or it can negatively affect value. Attractive and monster toning can and have fetched huge premiums, and there have been common date coins that are extremely valuable due to the toning they possess. Artificially toned coins, on the other hand, can often fool a collector, but most people stay away from them. Ugly toning usually doesn't make a difference as a dip can usually get rid of it without damage to the coin.

I have good news for you! It's worth more than 5 bucks regardless of the grade! :-) I actually see a fair amount of luster, and I'd give it an AU-55.
