1936 Rhode Island Commem - Grading Questions

This question has been bugging me enough that I decided to register and ask. I am new to the Coin World so if this is a dumb question go easy on me.

I bought a 1936-S Rhode Island Commemorative PCGS MS65 off ebay. Now, comparing this coin to a PCGS MS64 that is also on ebay I see that mine has some dirt or dark spots on the obverse while the MS64 looks very clean and shinny.

It seems that in grading they disregard these defects and focus more so on just wear (scratches/dents/etc)?

I guess I'm asking how can this coin be a MS65 while a coin that has much more eye appeal can be a MS64?

I looked over your coin alot, what defects do you see? I see toning, I deff would not call that a defect? Personally I like seeing that on old coins, I would be very happy to have that coin in my collection. Toned coins are often hard to grade through pictures that might be it too...

Hi, thanks for the reply. To me it looks more like black/brown spots than toning. That's why I was wondering how a coin with spots could grade better than a coin without any.

I am bidding on a coin lot on ebay that has a 1936 Rhode Island commemorative, a 1890 Morgan dollar, and 20 Kennedy half dollars. The 1936 Rhode Island looks clean. Are there any errors on this coin that I should look for?
