I disagree.
The defense has the right to present their case; which I am sure will include a lot of interesting "logic" to justify it. Of course, a case like this will probably be extensively covered and the issue will not go away quietly.
Do not think for a minute that we are the first to discuss these scenarios. Never underestimate a lawyer, let alone a large team of lawyers backed by politicos with an agenda.
