The "9" looks good but the Liberty does not look mushy (and should).
What does everyone think?

I think don't you have it..I rotated and cropped your pics a little because the angle was playing tricks on my eyes.I think the 9 is too high and the loop isn't quite looped enough. This is a tricky oneLet's see what the experts say.

I would have to say no, the nine does not appear to be level with the 7 and liberty appears to be strong, which automatically makes it a large date.

that is a tough one, but the nine looks like it is pointed down toward the mintmark too much to be a small date. I think what is really throwing it off is that the rounded end of the 9 appears to be somewhat pointed at the end which makes it look like a small date, but the nine doesn't appear to rounded out enough and the circular end of the nine points down to the mint mark too much to be a small date. Also the liberty seems to be too well struck to be a small date.

Overall appears to be a large date.

Update: actually, I've changed my mind on this one. Thinking further,I believe the "hook" in the 9 is damage or lighting effects. It's a large date.

The liberty is what is getting me for the reason you stated, Dave
But the nine looks good to me, that is the shape of it.
The level portion of the diagnostics is tough because it's reasonably close
if you draw a line from the 1 to the zero.

My gut says no:(

That is not necessarily true. That is a bad (single) diagnostic to go by.

To be honest, I'm getting a kink in my neck trying to look at it.

But, I'm leaning toward no, it's not a 1070-S small date.

I'm no expert, but it sure looks like one to me. The Nine is oriented toward the center of the Seven and the Zero appears in line with the top of the Seven. Could use a better photo though. It's hard to see the true strike of the Seven.

I'm leaning towards small date. Look at the seven. On the large date in the comparison picture, where the top and the side come together, where the arrow is pointing, there is a crease/valley. I don't see it on his. Also I think the nine looks good to me. Need a Zorb on the seven.
