looks EF-40 IMO but with edge nicks and scratches on obv.

I would give it a grade of AU-50.

First glance I am thinking AU territory too, but there are a lot of distractions on the obverse

In my opinion-too much wear on obverse for AU. I would say EF45

Absolutely a textbook AU, no doubt about it. Partial BF's, some detail in cottton bolls, talons are rounded with some detail, nicks and distractions are all part of the AU grade.

AU 50 is correct, although a little beat up on the OBV, still its a low end AU coin they can have those characteristics, the higher MS state coins will be dogged for such dings,,
