He's selling a fake coin that doesn't include the word 'copy' and he knows it. I'm sure this is illegal somehow...

If you want to buy a fake Morgan for $7.50, go ahead, but I'll bet you there is no silver it. ? Question ?
If the buyer AND the seller agree on a transaction that by innuendo, (in this case the 'buy it now' price), that the article is a fake, is that transaction legal or not?

Well, on ebay USA, replica coins are all supposed to be sold under the "Coins > Replicas and Reproductions" category. However, this guy's a magic supplies seller, selling them under "Collectibles > Fantasy > Magic". You'll note seller is also selling double-headed and double-tailed coins by the truckload. Yes, it's against the law and ebay rules. I'd reckon a high probability of the seller being unaware of this - this guy's been selling his magic coins for six months, but never sold a "magnetic" coin before.

on ebay, at minimum, it shouldnt be called a "dollar" because it's not. We cant put a photograph of Franklin, Eisenhower, et al and call the image a "half dollar" or "dollar."

Morgans are not magnetic, so how is he selling a counterfeit? It's still a "magic" coin, designed to jump to the magician's hidden magnet, not designed to fool collectors. HPA aside, I'm pretty sure even the ANA allows selling of counterfeits as long as they're sold as counterfeits. Think Henning nickels or contemporary counterfeits, both of which don't violate the HPA. I have a problem with his 1895 Morgan dollars - TWO Double Tailed Coins - UNC. How the heck can a two-tailed Morgan have a date? And since it's not a real coin, it's new, not unc. Aside: Magic coins have been made for decades, George Kirkendal, about 40 miles from here, is a master of the trade. Now, instead of painstakingly making one from real coins, they have the ability to make realistic ones from scratch a lot faster and cheaper.

The one in the picture has a mintmark of Carson City. It's a shame that these "magic coins" have to be of ones with rare mintmarks.

It's a counterfeit, plain and simple. Bought a pair of fake Ugg boots the other day with a magnetic buckle on them. Does that make it all OK? Because I should have checked before I bought them?

This is a recent piece and the HPA does apply to it whether it is being used as a magic coin or not. So the coin, and the sale are illegal.

If that's how you feel, report it and see if ebay agrees. He's selling it as a magic coin, not a real coin, IMO, not a violation.

He says underneath the picture that its a replica. He isn't trying to push it as a real Morgan dollar.

Good work? He was selling a magic coin AS a magic coin. What good work is there getting all bent about an honest transaction? The listing stated what the item was in a clear manner. He did NOT put it up as a collector coin. I am qite sure the only reason the listing was pulled was because of the complaints, not because ebay felt he was trying to sell this coin as a real Morgan. Oh, and NO, because he clearly stated that it was a replica, it was NOT illegal and NOT the same as buying a pair of rip offs being sold as the real thing. Nor was it being sold in a 2x2 as a coin. So please stop patting yourselves on the back because there was nothing here to start with.
