Ebay Not As Described Prob...please Advise

Hi all,

Since alot of you probably have more experience with ebay
thank I do, I wantd to ask for some advice.

I wanted to complete a 1999-present psilver roof set collection
and purchased the following from ebay:

I thought it was average to good price as I had been tracking these on ebay for a while.

I tried to pick a seller that had a good feedback record and the paypal buyers protection of 2000. just in case.

I paid with paypal with my discover card.

Problem is that (not being very trusting an all), I opened up the
1999 quarter set to check..and sure enough they were the clad
quarters and not the silver ones.

I just sent an email to the seller asking for a refund or a replacement. And I know that I have to wait the 10 days before
filing a Not as describe dispute.

I just want to get a feeling from everyone here what I should be doing
and to make sure I get this resolved correctly.

Wow, looks like you spent a bundle. I might add the shipping fee is quite high.

Does the box and plastic holder say silver or did they just slip in some clads in place of the silver hoping nobody would notice?

the shipping fee was right on...He charged 16.20 and the usps stamp was for 16.70.

The box and holder are all for the silver quarter, but the quarters inside are clad..
I assume they were hoping nobody noticed.

Maybe that the seller had both clad and silver sets open at same time for inspection and got the contents back in the wrong box, if that is so the he may still have a "clad" box with silver coins in it. I would suggest this to him/her as a means of indicating that it may be an honest mistake before filing a "not as described" situation. If it was an honest mistake and he still has the silver set he should exchange at his expense, if he has sold the other set you can bet the other buyer is most likely not going to say anything. I am assuming that the box you received had been opened, if it had not; then the mint made an error OR it was opened and resealed in an attempt to delude the buyer.

I am weary of buying proof sets from sources other than the mint. Somebody on ebay could have just cherry picked what they wanted and sell the rest, which doesn't give the buyer a fair chance.

Since you paid by Paypal, open your dispute with them instead of ebay. You will have a better chance of getting your money back. The seller's feedback is actually very low. You should be looking for a seller with a feedback score of 99.8 or higher. Obviously, there are exceptions to this rule, but it depends upon how many total feedback the seller has and whether negatives were received as a seller or buyer.

Make sure that you look at the feedback comments, also. Many dissatisfied buyers will leave negative comments in the guise of a positive feedback to avoid retaliation.

In addition to Susan's comments you also want to make sure to find a seller with a return policy clearly stated which unfortunately that seller did not. Hopefully he's honest and e-mails you back with an equitable solution if not then you already got some great advice from some folks.

no return policy wasn't a concern for me since I wanted what was advertised.

gormang, welcome to the forum! Plenty of experience and expertise here and friendly people with a willingness to share.

Actually, as Susan mentioned, the seller has very poor feedback; four of 262 discrete members who left negative feedback and another three who left a neutral isn't a very good track record. http://www.toolhaus.org/cgi-bin/neg...=Received+by
This guy sounds like a practiced con artist with all sorts of excuses (none his fault, of course) why a transaction went bad.

The lack of a stated return policy is another red flag. There are too many things which can go wrong in an ebay transaction and the buyer will be the one stuck with the consequences without a seller's return policy. My policy is: no return policy, no bid. If I want something badly enough, I'll email the seller before bidding and ask him/her if s/he has a return policy. If not, no bid.

You can also do a charge back on your credit card as well as the pay pal dispute ,, contact your card company to ask them the proceedure and give the reason .

I haven't gotten a response from my initial email to the seller.
I just opened a paypal dispute, and will initiate the charge back.

What do need to do to return the items: insurance, delivery confermation, certified?, registered?

You gave him less than 24 hours, on a weekend, to reply to your email before you filed a Paypal dispute? That's unconscionable, and you should expect a well-deserved Negative Feedback from that seller for giving him no chance to make it right.

I hate to sound so harsh, but what you've done is the kind of thing that puts people on my Blocked Bidders List.

I guess this is all a learning experience for me. I am so upset to be taken advantage of, that I am just trying to
take some action, and running with all the advice.

You have all been so informative about this process.

I really wish now that I would have waited to open the paypal dispute.
But for what I have read about the paypal dispute, it it just a way to
log the communications between the parties, and help come to a resolution, and if a satisfactory resolution is obtained, then it is just closed. I guess I need more education of why opening the paypal dispute now is really a bad thing.
I know now that it would have been more polite to wait and just use email.

I was already expecting a negative feedback, if I was forced to give one. I was withholding mine to see what the outcome
was, and was not going to give him a negative if this all works out.

Again, isn't the paypal dispute process there to facilitate a solution?

The Paypal dispute can stay private between you and the seller. Dependant upon the seller's reaction, it could be settled amicably. Because of his feedback rating, I have to say that I think you are safer to open the dispute now rather than wait. Sorry, but it appears that the seller could have been trying to hide something. He may not have been, but we're back to his feedback rating.

If you and the seller work everything out amicably, the Paypal dispute is simply a record of the communication. I would be sure to let the seller know that you are still willing to leave a positive feedback for him if he is reasonable in resolving this problem.
