And the HPA does not supersede the US Code, it is in addition to it.(The title 18 law is still current and on the books.) It provides a method of creating items that would be illegal under the US code by providing for the items to be marked. If the government chooses to they can still enforce the US code title 18 law against unmarked pieces.

As for the items made under the HPA I do find them to be a bit of a gray area. If the word COPY is not in the die or mold, technically all the pieces the company makes would be illegal from the time they are produced until they are counterstamped COPY. And the dies and molds they make them from would also be illegal. I think in these cases the government may be taking the intent of the companies into consideration. Since they know the company intends to mark the items with COPY, they let enforcement against the temporarily unmarked pieces, dies, and/or molds slide.

Hello. I was reading this thread as a non-member and I disagree that coins can't be made in the likeness of US coins that exist. I own a giant 2 oz. replica or a Mercury dime. It doesn't have a year nor any denomination listed. It's gigantic and could never be mistaken for a dime. It says that it's "2 troy oz. of 0.999 fine silver" or something like that. I also have a 1 oz. Morgan dollar replica that again doesn't have a year or denomination listed. If you don't know what you're looking for and don't realize that money has a year on it, it could be mistaken for a real one. It also says the usual "1 troy oz. 0.999 pure silver" line. None of them say copy. There are also replica coins from leftover dies from mints that people strike and sell. I really think it just doesn't matter to the government anymore in the case of silver because they don't make silver coins and melting silver coins was legalized in 1969, anyway.
