But we don't know if the seller or the manufacturer of these coins have acquire the right to re-use those image either.

Doubt it. Nobody pays for a line of unique packaging and then sells the right to the brand to some little guy to make his own competitive product. That would be like Labbat licensing the "Labbat Blue" bottle and label to mico brewery.

Right, I doubt that too. But the current copyright law, the way I understand it, require the copyright owner or licensee, which means the design company or the Mint, to take action. So unless anyone bring this to the Mint's awareness, there is not much we could do.

"I wonder if the person bidding on it realizes it isn't an RCM product. I might venture to guess that once in hand, buyers might become angry once they see it's not official"

Since the bidder is private, it's entirely possible it's a shill bid, eg they've bid on their own object from a 0 feedback account to make it look like someone has interest in it.

I didn't realize that you could place a shill bid simply to generate interest. Since the seller doesn't allow refunds and s/he hasn't lied, there's not much a buyer could do except to enjoy the purch ASE

If you look on their completed listings, the original ones were in a red box. They have since changed to be very similar to the RCM offerings, they also indicated mintage of 9999. - buyer beware

Hard to make out some of it, but assuming the sticker is the same as on the older red boxes:

Left side with Bar Code:
- BAR CODE #
- 780435 656785

Right side with item description:
- 24k G.P
- 2012
- Circulation Penny
- # _ of 9,999

"I didn't realize that you could place a shill bid simply to generate interest. "

An item with 1 bid on it looks more legitimate and desirable than one with no bids ... the idea being "Oooh! Someone else thinks this is a good buy, well I want one too" ... sorta :)

This is all of course a case of buyer beware, but it burns my butt firstly because I don't like seeing people ripped off but secondly because the people who are getting ripped off are potential new collectors who won't think much of the hobby after being scammed.

This has to be illegal, I can't beleive the mint hasn't put a stop to this. It's ridiculous, I bet half the buyers think its a mint product or all the buyers ðŸ'¿

I directed my 'mint-rep' to the ebay item.

He replied "Not our product. Someone was creative and decided to plate regular pennies."

It's funny, I figured they would be all over it as a copy write infringement.

This item is illegal in Canada. I will not got into the counterfeiting law here in Canada but "yo alter any Canadian coin" is counterfeiting. I have no doubt these items will disappear very quickly from ebay. It is against ebay selling policy as well.

Now I wonder how many shill bids there are on ebay simply to raise the final price of an item and/or generate interest. I remember once bidding on an ebay item where the bid after mine was disproportionately higher compared to other bids.
