I fail to see how adding plating to the coin will violate Canadian law. I applaud the seller, it's a genius idea, as long as he makes it clear that he is selling a privately created commemorative.

Besides playing on the 'last penny roll' madness, they are producing an item that you would see from Franklin Mint or Bradford Exchange - flashy, terribly overpriced, and little chance of appreciating in value . The layman may think they are getting a great deal, but it's more like snake-oil. Buyer beware.

If you look at his completed listings, he did not have success in selling his red boxed 2012 final gold plated penny. He switches to the box and packaging that is the same colour and design as the Mint and voila - his product sells!

I think it is absolutely genius.
The problem is the packaging and failure to make it clear that it is not a Mint product. If you're willing to trick people to make money, that is disgraceful.
The limited edition (9999) is bogus because there is nothing preventing someone else form plating 10M pennies.
I don't know about the defacing coin law in Canada. These coins are just coated. And you can find colorized and even scratch and sniff Canadian coins for sale, so I don't think the government is going to be too upset about a little gold plating.

He doesn't insinuate it's the same as the 1/2 ounce coin, not same series, not same mintage.

No he's not....BUT what he is doing is using very similar packaging and imagery that the RCM used on all their "farewell" products. An uninformed buyer may reasonably think that this is another item put out by the RCM in their group of "farewell" offerings or they could mistake it for the 1/25 oz gold penny if they weren't paying close attention. if the RCM does not act on this sale it shows how little they care for their own products and the collectors who support them. Can you imagine Coke or Pepsi allowing someone to package products in a knockoff design

All the farewell to the penny products are sold out, no new products are dew to be released. As far as the mint is concerned they are not misrepresenting the product as a mint product, there is no mint logo on the product. This packaging will never be reused, so its not like steeling a coke bottle design. I don't really see a problem here or why so many have their nickers in a knot.

Or New collector makes this knockoff his/her first purchase - sees that the quality may not be up to their expectations; decides not to make any further coin purchases. Nothing wrong with competition or offering a competing product; however when blatantly using a competitor's design to sell those products, it becomes an issue. It is similar to counterfeit Gucci, Louis Vuitton, etc. items.
