Needed Help For An Issue On Ebay Purchase

Hello everyone.

It took me a while before I finally decided to post here as I was and am trying to resolve the issue with the seller, but now I probably got to the limit of my trust with him.

Almost two months ago I made a big value purchase: 700$ + 15-20$ Shipping. One the picture the coin was in a capsule and everything was great. When I won the auction, as it was an auction, the seller sent me a message that he'd like to bring it himself as he lives in Ontario and I live in Quebec. I didn't like that idea as I am selling myself and am always shipping without any issues, so finally he shipped the coin.

When I received the coin, it was inside the set, but not in the coin capsule itself. The coin was also scratched, which for a real collector it means A LOT, as it's numismatic price simply drops enormously.

I wrote to him and as an answer he told me that Canada-Post did it ... I mean SERIOUSLY ? Canada-Post opened the parcel, took the coin out of the capsule, put it back, closed the parcel. And by the way, they should have also scratched the coin before putting back, or simply the coin got scratched in the box.

Anyways, it's been an on and out-going communication between us. I stay respectful while he is trying to resolve the case with Canada-Post, but from the beginning I didn't really believe in the whole story.

Never happened to me ANYTHING of that sort with my buyers. I had to message him again yesterday. Here's my message and his response:

Me:

Hello,

As you mentioned last time, you were supposed to get an answer within the upcoming week. Are there any news? I can wait until about the 20th of April, after that date the item will disappear from ebay, therefore I'll have to open a case with ebay for them to solve it with paypal, or whatsoever they do before that date if there are no news on the issue.

His answer:

I am committed to finding a solution good for both of us, and accordingly it will not matter to me whether it shows on ebay or not, I will work on this until we reach a solution, please believe me.

The situation is as follows: Canada Post pays only $500 maximum, however, once they pay an amount they take possession of the coin. Hence, if I agree to that: 1. You loose the coin, and 2. I loose over $200.

I am trying to avoid both of those scenarios and have asked a friend (in a legal firm) to see if there is another way around it. I am meeting with the friend next weekend. One other thing I had in mind was to discuss with you an amount equivalent to the damage (depreciation) that we can both agree on and maybe under some clause (hopefully my friend will find something) I can ask for the depreciation amount (which will then be transferred to you) without forgoing the coin.

Please let me know when we can talk, I can call you or even meet you over a coffee (I will be in Montreal on Thursday).

If I want to open a case, I should do it before the item disappears from ebay.

Please let me know what you think, any ideas, help, experience would help in this situation. Thank you very much for any help.

Open up an ebay dispute claim... tell them coin is damaged and you want to return for refund... don't back down until ebay finds in your favor... when they advise you to ship back to seller, securely package the coin and ship using a method which is trackable and has "signature required on delivery", or seller could tell you he didn't get it...

I would definitely open a case and have ebay help resolve it. At the end of the day it is your hard earned money your spending on a product that was not as described. I wish you luck with your issue. Please keep us updated.

You need to open a case on ebay or paypal ASAP - once so many days past then the buyer is SOL. Good luck
Keep a record of all this, even video proof.

Thank you for helping. The seller seems nice, but only problem he is new and I dunno how trust worthy he is. I'll definitely keep you updated. I'll ask him for the case # with Canada-Post. I'll try to make sure there is actually something he is trying to do. Don't want to ruin someone's reputation if it is not their fault, even if I really don't think Canada-Post would do something like opening a parcel and ruining the item.

I've talked to other collectors and people dealing and selling on ebay. All of them told me to open a case with ebay or paypal ASAP. Before I do that, I wanted to ask you if there is a case number or something by with you are contacting Canada-Post, as there should be one. Also, there is no need to meet or talk if it is Canada-Post that opened the parcel, took the coin out of the capsule and scratched it. ebay and Paypal will deal with it then. But everyone tells me I should open a case as I am under the paypal buyer protection.

Should open a case asap. Good luck with it.

I have to deal with a very abusive buyer lately related to a watch I sold on ebay, gives me enough grieve. He opened a case on the purchase, locking up the fund simply because the useless tracking number provided by paypal provides him with no real shipping status update. Lesson learned for me.

You are certainly giving him the benefit of the doubt, and I admire that. At the same time, especially since you clearly are more than fair to someone, I'd really hate to see you get shafted over this and I echo everyone's comments about opening a case on ebay or Paypal. My best wishes for a speedy and fair resolution for you!

@tocoins, Good luck with the buyer. Had also a case when a buyer left me negative because the coin said to be uncirculated in my listing was not an ms70 -_- ... Some buyers simply don't know stuff. Luckily got him remove the neg by refunding him.

There is not much you can do, best thing would prolly have been to return the coin for a refund. One time I bought a coin from ebay and once in hand (slabbed coin) noticed a rim ding not obvious in the picture but it was sorta there if you looked really close. The seller was nice and refunded me $30 (from $250) to make me happy.

Here it is more complicated as on the picture the coin is perfect and seller states it is Canada-Post that did it. If not, it should of been me, right if he sent it in perfect condition He wrote his part, decision should be there by May 7th

People need to understand that the seller is responisble for everything they sell on ebay. That included damaged and lost shipements. The seller has to protect themselves with the tools provided by their shipper but can't hide behind the shipper when something goes wrong. Here are some examples:

A) You buy a gold coin with free shipping and it never arrives. The seller claims they sent it letter mail and can't provide an insurance number or a tracking number. In this Case ebay will refund the buyer the money.

B) You buy a glass vase on ebay and the seller neglects to package it correctly and it arrives damaged. This is the sellers fault as even Canada Post will examine the packaging before issuing a payout on an insurance claim and if they find the item was not packaged correctly they will deny the claim. In this case ebay will ask the buyer to return the item to the seller and the buyer will receive a refund.

C) You buy a collectable set and receive it with an item missing. The seller may have made an honest mistake, the item may have been tampered with or the buyer may be corrupt but in this case the seller will loose regardless. All the buyer has to do is file a item received not as described case and send the item back. The buyer receives a refund automatically. In this case even if the seller can provide documentation that the item was shipped perfectly ebay will always side with the buyer.

As a seller you can not simply use the excuse it was not my fault. The seller accepts all responsibility for the sale of the item. I had one case where a seller sent a silver coin without tracking and it went missing. The seller simply refused to believe that a package could go missing. In the end it was their fault for trying to save a couple bucks on shipping when I paid for tracking and ebay refunded the money back to me.

Just a side not. If you are a buyer returning an item, you must send it back with a tracking number.
