Why Would Somebody Report My Listings As Replica From CCF?

Hello
So today I got to my ebay and noticed all my listing were removed as a result of a CCF member because he claimed my coins were replica. My concern is why would anybody replica a 2012 Canadian penny ? I get these coins plated WHICH is NOT illegal in any shape or form I clearly state in the description the coins were plated by a third party and not the mint.. So why would someone report that to ebay and ebay without reviewing properly remove my listings. I have provided a listing that was removed and would love it if someone can tell me what exactly what I violated? Thanks guys

I dont see anything wrong there..eBay lives in there own world..took me almost 3 weeks to get them to close a case in my favor with a customer saying he never got the item, when it clearly showed that it was at post office waiting on him to sign for it..some times I dont think they really take the time to check things out before they act..

That's exectly my point its almost as if they didn't even check to see if replicas exist.
P.S I forgot to the comment of the CCF member who reported me

I find that a pathetic attempt to ruin somebody's reputation
Here is also the first topic about this when CCF members actually checked Canadian laws and stuff like that and could not find any type of violation.

I don't see anything wrong either, I'm very surprised ebay just shut down the auction?

I have had similar experiences with ebay favoring the first party who complains. This is going to require a few phone calls to ebay customer service and a bunch of emails. They will probably reverse their decision if you are persistent enough, but don't lose you cool when talking to those nice girls in Customer Service --- the ones who can't ever answer a question without putting you on hold over and over,
Yes, ebay can be extremely frustrating when any concerned citizen can just call in or email a complaint about any little thing.

It wasn't just one they removed 15 listings. Here is the message they sent me..

Hello banknotes--coins,

After reviewing your ebay account, it appears that you have violated ebay's Replica Coins policy. We realize you may not have been aware of this policy, or that this may have been a simple oversight, but unfortunately, we had to take the following actions:
- Violating listings have been removed. A list of removed items is available further down in this email.
- We have credited any associated fees to your account.

Replica coins are not allowed on ebay.

ebay may end any coin or currency-related listing if we believe that the sale of the item might create liability for the buyer, the seller, or pose a risk to the Community. Sometimes problematic auctions are identified by a group of members that comprise a Community Watch Group for currency listings. As far as the exact problem with the item(s), the following was received from the Coin Community Watch group: "All of these are illegal in Canada as they are altered. They are against ebay selling policy for Canadian coins. Remove them all please." With regard to the assessment of the listing, as ebay employs no experts in the field of currency we are unable to arbitrate disputes. Please do not relist.

Please be sure your future listings follow these guidelines. If they don't, they could be removed.

I'm sure their policy is, better to pull it and keep us out of trouble, and sort out the truth later if someone complains enough.

Your OP stated that a member of CCF reported your listing. I could be wrong but suspect that isn't true. The ebay message to you quoted above clearly states the Coin Community WATCH group. It's my understanding they are not affiliated with CCF.

ebay CCW has nothing whatsoever to do with CCF (aside any CCF members who might also be members of CCW...). CCW is an eBay-affiliated group of numismatic experts whose role it is to find, recommend, and evaluate reports of improper coin listings on ebay.

But if they were doing their job properly they would quickly see there is nothing wrong with what I am doing. How can they come to such a conclusion. I honestly don't understand how they made the connection that they are replicas? Or which Canadian law I violated (which I didn't). I did do research before I posted these coins and I could not find anything wrong or illegal about it.

If there's a separate group with a very similar name, that could end up being very confusing, since there seem to be many members here who do the same thing...

Ok with that being settled. What is illegal about what I am doing? I have review the ebay policy and I still don't see anything also reviewed Canadian laws about coins again nothing about what I am doing. Only topic about plating would be on bullion which has nothing to do with me.

Is it legal in Canada to alter coins? Maybe a member from Canada can answer.

Also from a numismatic point of view I don't think the coins can be graded uncirculated as they have been altered. Perhaps uncirculated-details?

Not quite true. There is specific mention of plated coins being illegal, under certain circumstances. It was not mentioned in the other thread, but the relevant law is the Criminal code, Part XII - Offences relating to Currency. In the definitions, it clearly states...

(e) a coin cased with gold, silver or nickel, as the case may be, that is intended to resemble or pass for a current gold, silver or nickel coin, and

(f) a coin or a piece of metal or mixed metals that is washed or coloured by any means with a wash or material capable of producing the appearance of gold, silver or nickel and that is intended to resemble or pass for a current gold, silver or nickel coin;

So plating a coin to make it resemble another "current coin" is illegal. While this law is clearly aimed at people trying to "upgrade" their coins by, say, turning a 1 cent into something resembling a 10 cent piece by painting it silver, the law doesn't actually say that - intentional resemblance to any "current coin" is technically a counterfeit and therefore prohibited.

The question then becomes, do any of your plated coins "resemble" an official government-issued coin? Has Canada ever issued, for example, solid gold 1 cent coins, which your gold-plated 1 cent coins would clearly "resemble"? Or, given the rather liberal definition of "resemble" that some folks here in the Canadian subforum prefer to use when talking about counterfeits and fantasies, is it enough to argue that a gold-plated 1 cent coin "resembles" an as-yet-hypothetical solid gold 1 cent coin which the RCM might have struck, and is therefore also illegal?

Perhaps just as important as the word "resemble" are the words "intended to". Did whoever do the plating "intend" for any confusion to occur? The plating itself was intentional, in that they didn't plate those pennies with gold by accident, or choose gold at random from a list of possible colours - they deliberately set out to make a gold-looking coin. Yet you're clearly not "intentionally" selling them as solid gold RCM-issued coins.

As you can see, the law is not as clear-cut as all that. It's certainly murky enough to explain why someone reported you, and why ebay listened to them.
