Last week I had reported an obvious CRACK-OUT to ebay:
1851-O $20 Gold Crack-out:
item#:310776420434
item#:390675086294
Seller, centsles, bought this coin on ebay as item #390675086294 in an NGC AU details-Brushed holder. He cracked this coin out and has listed it as an AU-58 with NO mention of the known defects.

EBAY RESPONSE:

Thanks for reporting this listing to us.

I reviewed this listing and through close examination was able to confirm that these are two different coins pictured in listings 310776420434 and 390675086294. The markings on the cheek vary sufficiently that I'm convinced.

If they are NOT both the same coin, than I have no business collecting coins. The forensics are so overwhelming on this coin that only a blind person could have come up with this determination......Centsles, the Teflon Don is untouchable.

He made a good chunk of change flipping that coin. Yes it is the same coin. He sure has a ton of negative/neutral feedback.

you seem to be aggravating yourself to a high degree over this person. Where I for one can appreciate your watchdog like mentality and proactive efforts to protect our hobby, I also have to comment that most members here recognize who this person is, where he can be found at major shows and of course, watch his coins with a closer eye due to his practices.

in the end, you're fighting a fight you cannot win. ebay is a mega company with hundreds of millions of dollars and if this guy adds to their bottom line, he adds to their bottom line and that's that. Their attitude, and rightly so as it would be mine as a business owner, is clear on this one: if you don't like it, seek life elsewhere because we're not going to pass up $100,000 in annual commission for the righteousness of it all.

Look at the response you got, it clearly says to go away. Again, great and valiant intentions on your part but you cannot beat the money machine.

Okay, I am not an expert, but what about all of the other markings that are in the same places.

IMHO you have an amazing eye and memory for this. The best we can do is to keep us the good fight and try not to get discouraged when this happens.

I don't know, it took 2+ years, but, we were able to get rid of the biggest ebay cash cow neyronix. What really irks me (sorry for the foul language lol) is this one is so obvious....Oh well, and the beat goes on.

The top picture is using way too much light to compare both photos. You need almost the exact same exposure to come to an accurate conclusion. It also depends on the pixel of the camera as well as lighting.

DSFree is right on about ebay..... Its a market plagued by fraud and unethical practices that typically make my experience a crappy one on ebay.

I've given up on ebay, I rarely sell there anymore due to their inconsistent policy and allowing unethical sales. Very Long story - short version, if it makes ebay cashola, and they can appease the seller and buyer, its all good, whether the merchandise is or not.

To knock some one off ebay is one thing. All they have to do is create another account with either a new credit card and email, or simply use a company credit card.

By the time you kick them off, they are filthy stinking rich. They can afford a lawyer and throw mud back at ebay. ebay is in it for the money and would probably not pursue it anyway.

You might be able to contact ebay as part of the dispute process. I recall that they offer a phone number that can be used if you're still not happy with the results of your discussion with them. I bet they might agree with you if you went down that route.

Any relatively well-versed photographer can make up for all of this intuitively. It's not difficult. Which makes this all the more egregious - there isn't a shred of doubt that these are the same coin. The evidence is overwhelming.

And this is why ebay's taking away the item links in a seller's buying feedback is not good. It will be almost impossible to track things of this nature.

I completely forgot about this seller! Is probably considered one of the worst in online coin dealing history by many people.

There's another guy on ebay who does this, I know because he bought a high value silver dollar from me MS-60/stained in a legit holder. Reholdered it in an NNC slab MS-63 problem free. I don't know if he went on to sell it but it struck me as major major chutzpah on his part. BTW he also uses multiple ebay user IDs (2 for selling 1 for buying) to cover his tracks.
