That's a lot of house for the money

Real estate prices in Ohio are some of the lowest in the nation. It is not rare to get a nice older house for under $100k. The reason for this is that Ohio, northern Ohio especially, is right in the middle of the rust belt and has seen its manufacturing industries decimated. With the population on the decline and the employment base heavily eroded there are many more homes for sale than there are buyers.

I will say, being from the area, I'm really surprised by the price. While the home is REALLY nice, and the parking lot is very spacious, and if you bought the lot next to it, you'd have just a massive amount of yard, the location leaves me wanting.

Unless you are really looking to have the biggest, nicest, house on the block, you aren't buying this for a residence. And without significant remodeling, you probably aren't doing a lot of business in the building.

The residence part is probably more likely. It's within a couple of blocks from the hospital, a mile or so from downtown (where Abon is located), and that's really about it. To one side, you have a doctor's office, to the other side, a body shop, behind it some more residences / small businesses, across the street a former elementary school now medical building, and a Mental Health Practice.

I'm trying to figure out why the house is going on the market. When they seized most of the other assets, I was surprised that the house wasn't part of that really.

Here we are, a month later, and NOTHING has come out. The business is still open, albeit with far less cars around when I drive by, the house is up for sale, indictments have been placed, and.... nothing. No dates for hearings have been made public, nothing.

I'm beginning to fear that this might go nowhere. I have heard rumblings that they are back on ebay, but I have yet to be able to track them down using conventional methods.

Not to worry. The legal system grinds slow, but exceeding fine.

Trial is set to begin in Cuyahoga County on monday, the 23rd. Here is an article that "also ran" in the local rag of a newspaper.

http://www.mansfieldnewsjournal.com...ry/20834601/

Mr. Berry, has been walking around town pretty smug about the whole thing since he left his employment, while the Bence's have stayed pretty secluded. Berry seems to think that this is all going to blow over, and he wont have any problems beating the charges. I'm not sure if that is ignorance, idiocy, or state's evidence speaking.

So far, no one else has been charged. I am curious to see what happens if they are convicted, as they charged the business in this as well. Could that mean that the business is closed? What about the inventory? So many questions, so few answers.

Those are some pretty serious charges under RICO.

I will be trying to find updates about the happenings in the trial. If I find anything (that I'm allowed to share), I will post it.

I find it interesting that they chose to prosecute in State court even though the Feds were involved with the investigation. Many states have enacted their own RICO laws; Ohio's must have been better for this case. That's scary for the defendants because the Federal penalties are tough as it is.

Thanks for the link, thatguyoverthere.

My first comment is that HTML5 has enabled annoying ads to get more annoying.

Oh wait, this is about numismatic crime, not pet peeves. Anyway...

The allegations include supplying "shoppers" with lists of desirable items for which Abon would pay a premium, according to the indictment, thereby encouraging people to steal from national-chain retail stores.

Yow.

The Bences' home at 136 Marion Ave. is for sale. The listed price is $149,500.

and Zillow estimates it at $123k. This should be interesting.

Sad situation.

People need to learn to use public information instead of depending on the (stupid) media and (old) news articles...

Court dockets (http://cpdocket.cp.cuyahogacounty.us/) are public information, use it or lose it...

OK stepping off the soap box...

All charges against Donna Bence and Benjamin Berry were dropped on 10Feb2015. Without prejudice (so it could be refiled)

Well, that was disappointing. He's going to get probation, the business will get fined. His life will be ruined, but the business will still operate. I'm not sure who will run it, or who will staff it, since according to those still affiliated with the family, his son and he are "estranged". Which is surprising, because it was always understood that his son, and one of the employees who is no longer there (not me, I left too long ago for that) would be "taking over" and running it as Larry stepped down. For his son to have the opinion that he does now (I've seen Screen shots of a social media post hoping his father would get 10+ years / die in prison), is a little surprising.

AS far as the plea deal? He took the deal to keep Donna out of trouble. I think the prosecutors could have pushed for more, and he still would have taken the deal to keep Donna out of the courts, and out of trouble.

Now, how that little turd Berry made it out of this unscathed, I will never know. From what I have heard in speaking with multiple people I knew who were employed there at the time of the raid, Berry was a "mini-me" to Larry. He was his toady, a contemptuous little irritant, who very likely knew exactly what was going on, and the color and smell of Mr. Bence's Colon.

The hilarious part of all the motions, is that he wants to know who the mole was. He had rid the business of almost every single person who has been there long enough to be a mole about anything "important" since then. Knowing Larry the way I do, it's GNAWING at him that someone ratted him out. It's that itch he can't scratch, it keeps him up at nights.

And, I'm pretty confident I know who the mole is. As in, if I were a betting man, with resources, I would wager a very large sum of money on the name.

I doubt that the article covers the rest of the terms of the plea bargain. Beyond the guilty plea and whatever sentence comes out of that are often other terms. I don't know if the terms are public info in that county/state, but any consent order should be...

Stay tuned for another chapter of "As the stomach churns".

No, it doesn't explain more. I'll be watching the court docket to see what they make public that way, but It's hard to say. I've seen cases where nothing is made public, and I've seen cases where everything has been made public shake down in Ohio.

Oh well. I'll keep watching ebay for my handiwork to show back up in auction format.
