An expensive coin I purchased in August has still not arrived, so I opened a dispute on paypal. Here is the transcript so far (names were edited out). --------------------------------------------------------------- From Buyer: on 9/11/2007 19:29 PDT Coin still not received - 30 days after payment sent.
From Seller: on 9/12/2007 06:35 PDT This item was shipped 8/13 USPS tracking# XX XXX XXX XXX US, as I had previously informed the buyer. I asked him to check with his PO, usps.gov and Canadian customs which may have it. I informed him that USPS requires waiting 30 days before claim can be filed and to contact me then if he had not received it.
From Buyer: on 9/13/2007 19:31 PDT 1) There is no tracking information or any record of mailing for tracking number XX XXX XXX XXX US on usps.com. 2) I have called the Post Office twice to check if they have the item. They do not. 3) I am not sure why the seller suggests checking with Canadian customs. The seller's web site says he is located in New Jersey and I am in Massachusetts. This makes no sense to me. 4) Normal time for first class mail between New Jersey and Massachusetts is 3 days. 5) Today is Sept 13, so it has been thirty days since the item was mailed and it still has not arrived. 6) I respectfully request an immediate refund.
From Seller: on 9/14/2007 07:29 PDT My mistake, ignore the customs comment, I was confusing this order with another. Now that the required 30 days has passed I will file a claim with the PO. I can also fax the mailing receipt to prove shipment if the buyer wishes. This issue will be resolved through the PO's claim system. They are responsible once it has been shipped.
From Buyer: on 9/14/2007 14:32 PDT It is the seller's responsibility to deliver the purchased goods safely to the buyer in a timely manner. The post office insurance provides the seller protection against loss in the mail, not the buyer. The insurance claim is a matter solely between the seller and the post office. Since the coin is lost, and therefore the seller cannot deliver the coin to me, he should refund my payment at this time. I repeat my request for an immediate refund of $600.
From Seller: on 9/15/2007 05:21 PDT The official procedure is that the PO must investigate and confirm whether the item was delivered or not. If the PO confirms it was lost then they will reimburse buyer for loss. Check with the PO and they will confirm the process. I will get claim forms from PO today and file Monday. The PO will then investigate and contact the buyer.
------------------------------------------------------------------- Any advice? What should I do now? Wait (for what?) or escalate the dispute now to a paypal claim and break off the dialog. My experience with the PO insurance claim process is that it takes several months to get a settlement and requires several inquiries as to the status of the claim to get any action at all. As I understand it, the insurance is for the seller, not the buyer. I don't want to be unreasonable, but I really would like to get my money back and look for another coin to buy now. Your experiance is the same as mine ,, the PO will eventually maybe settle the loss ,but it will be with the shipping party not the intended recipient .
I would if it was me file the dispute through pay pal , and credit card if that is what was used for the purchase .
Let the seller wait for the post office to do whatever it is they do .

I would escalate it simply due to he having his facts wrong on the post office reimbursing you. P.O. protects the sender ( seller ) not the receiver ( buyer ) so I would just escalate it since he has no proof of delivery and paypal will valiudate the claim that insursance covers him and nto you and you are covered by paypal buyer protection.

For all the reasons above, I agree, "Don't wait, escalate." The seller needs to fulfill the obligation to you and work out the details with the Post Office for his loss.

I would ask him if he sent it through "Click-N-Ship® or eBay®" because if he did I just checked USPS.gov and found out the rules had changed on May 14, 2007, it now states the sender or addressee can file the claim if it was sent through these methods online. Here is what it says: "Starting May 14, 2007, customers who purchase Insurance online through Click-N-Ship® or eBay® have the option to file their claims online through https://www.usps.com. Either the mailer or the addressee may file the claim. Whoever files the claim online will need to provide: the article number, proof of mailing, postage and insurance fees paid, and proof of value. For damaged claims, the damaged item with mailing container, including any wrapping, packaging, and any other contents received must be presented at any Post OfficeTM - along with a copy of the printer-friendly completed claim summary from the online application. Also see Proof of Damage"Now it doesn't say who will receive the claim (the sender or the addressee)if they are the ones that file the claim so you may want to ask your post office directly about this if he states he did send it through an online source like they are talking about on their site

In most cases the buyer would not have some or all of this info ! Don't mess with it ,, you have limited time to file your claim ,, If you wait for the PO and the seller you will lose any leverage that you have . at this point you have no proof of shipping (tracking does not show the Item ) you have no proof of insurance either based on no tracking info . Smells like fish. USPS Tracking number xxxxx probably doesn't exist. Canada has absolutely nothing to do with it. Sounds like stalling double talk to me. $600 is a lot of money to be waiting around for someone else to figure out. I think 30 days is too long to wait without the seller trying to better resolve this.

Thanks everyone for the advice! I thought I smelled fish too but was not sure. Maybe a total fraud. Maybe he sent the coin to someone in Canada and is confused. Seems like it is time to escalate.

I decided to post one more message to see if he will refund the $600 before I escalate it to a claim. ----------------------------------------------------------------------------------------------------- I respectfully disagree with the seller. The postal service will reimburse the sender for the loss of the coin, not the intended receipient. By accepting the payment for the item, the seller has a responsibility to deliver the item safely to the buyer in a timely manner. As stated before, the item was not delivered. The item never reached the local Post Office. This is a fact. This fact is corroborated by the complete lack of tracking or delivery information on the usps.com web site for item #XX XXX XXX XXX US. Furthermore, this fact has been confirmed by the local Post Office. In light of this fact, the seller should issue a refund, since it has been well over thirty days since he received payment, and since the coin is lost, he can no longer deliver the item. I don't understand the hesitation to issue a refund, since the seller is covered by the insurance he purchased to cover his loss. I respectfully request that the seller issue a refund now for non-delivery of goods and resolve this issue. ------------------------------------------------------------------------------------------------------ I hope that he will just issue the refund. Not bloody likely, though.

Here is the seller's response: ------------------------------ The PO reimburses buyer if the claim requests it. I will request that when the claim is filed. ------------------------------

The online tracking information provided by the seller was not sufficient enough to confirm that the item was shipped to you.You have received a refund of $600.00 USD for this claim. Any portion of your original payment that was funded with credit has been refunded directly to that credit line. Please allow 3 days for the refund to appear in your balance. ------------------------------------------------------------------ Wow, thanks again for the good advice, I really thought I had lost this money!
