I noticed that this coin had a scratch on it, but after looking closer, I noticed the scratch is under the lettering in Jacques, so it must have been there before stamping...
Hope the pics show it, if not, I'll try to get better, closer pics.

Not an error, just damage from a coin rolling machine. The lettering on the scroll is incuse, so scratches will look like it goes "through" it. It's just a trick of the lighting in your photo.

I tried making a diagram... I can't do perspectives. They almost always end up in total failure. I hope this clears it up why it looks like the scratches "go through" the incuse devices.

Nope... remember, the lower legend in that coin is incuse, not raised, it would take a pretty deep scratch to bottom out in those letters; SlurExe97 is right in this case.
