Here's the situation in a nutshell:
10 days ago, I purchased a coin from a seller in the UK; a British Shilling advertised as Uncirculated which looked quite nice in the seller's photos.
What I received a few days later was the same date coin, but clearly polished and scratched. At the time, I assumed it was the same coin pictured in the listing, but wrote it off as tricky photography. I told the seller that the coin I received was polished and filed for a return. Seller accepts, and I shell out another $7 to ship it back to the UK.
Now this morning, the seller contacts me saying they received my shipment, but they claim the coin I returned is not the one they sent me (this is absolutely FALSE).
After careful study of the photos, it is now clear to me that I was indeed sent the wrong coin in the first place, but the seller claims that since I did not propose that possibility in my original return filing, that claim is not credible and I am not entitled to a refund.
I don't know what else I could have done short of taking video of me opening the package after I received it. Where do I go from here?

Was this an ebay puchase? How did you pay? With Pay Pal?

Open a case with ebay... you should be covered, if it comes down to your word against the seller, ebay will almost always side with the buyer If for some reason that doesn't work, there are other options to look into after opening case, but it shouldn't need to go that far

Quote:Was this an ebay puchase? How did you pay? With Pay Pal? Yes, and yes. All said, I am out about $70 because of this. I don't think I will get anywhere arguing with the seller, so I guess my only avenue is to pursue a case with ebay. It's just that this is completely new territory for me and I'm unsure how to tactfully approach this.

If it helps any, here is our correspondence so far: seller's message: Quote: Hello I received a 1900 shilling back from you, but it is not the one you purchased from me. the coins has scratches to the obverse side, mainly one which is clearly visible in the obverse field in front of Victoria's head,(see photo attached) the one we sent you did not have these faults which I mention. I enclose a photo of the head side to show the coin returned, which shows it to be clearly different to the one you purchased from me I reply: Quote: The coin you have received is the EXACT same coin which you sent me. Further, I question whether I was even sent the coin pictured in the original listing.
If there is a fault here, it is that I was sent the wrong coin in the first place. Have you double-checked your inventory? seller replies: Quote: Hello Many thanks for your reply. I am not going to get into an argument with you. Your reason for returning the coin you purchased, that it had possibly been polished/cleaned in your words, which I accepted as a valid reason, for a return the item case you opened against me. And you are now questioning, as if the right coin was sent to you, which is hardly creditable, as there was no mention about this, prior to my e mail today or the case opened by you., Without a doubt a although the coin is same date, it is a completely different coin you returned, to the one you purchased and sent to you., I try at all times to be open and honest in my dealings with customers and would never send them a different coin to the one advertised. Regards I want to believe this is all just a misunderstanding on the seller's part. They have near spotless feedback on ebay, and nothing points to them being a scam artist. But they are adamant on their position that I returned them a different coin than the one they sent, and I know that is 100% wrong.

There is no point to reasoning with the unreasonable. This is the exact reason, as intended for ebay to step in.

On the return detail page, it shows the item status as still in transit, and the tracking hasn't updated since the package left the US 4 days ago. I don't see any option on that page to open a case with ebay.

If you return the coin with tracking showing that it was returned it's probably not going to matter to ebay what you returned. Keep the case open with ebay and you will most likely get your refund. It looks to me like the seller really does believe you returned the wrong coin, even if you know it was the one sent to you. As much as some folks scream about how bad ebay is, this is a good example of why buyers trust ebay so much.

Kefiroth - It's good advice to persist in the Resolution Center. If your feedback is strong, you will probably win the case.

Thanks for the advice, all. I think I'm going to wait for a day or two to see if the tracking finally updates (I sure hope it does). I don't think ebay will help me if my return doesn't even show as having been delivered.

He's not being unreasonable, hes trying to con ebay. He's getting ebay to pay him for it so he can triple his money when he sells it again. PERIOD... to ebay it's a "he said / she said" situation. They will refund both parties money. You're not out a dime but it will be in your internal history with them. He dosent care about you and he knew his game plan when he sent it to you on eat he was going to do depending on what you say when you receive it

Yeah, once the seller gets to that point, there's only one option. Just open a case with ebay, and they will refund you. You returned the coin, so you'll get your money back. I would probably let the seller know what you are going to do, sometimes they come around with the threat of a case, and negative feedback.

And when you write emails to him word it like you're talking to ebay too. They will be reading them!

Update...sort of. Now more than 5 days after the seller acknowledged the arrival of my return, the tracking still says that it is in transit (no updates since it left US soil). As such, ebay will not allow me to pursue any sort of further action through their website, as "a return has already been initiated for that item". Apparently, the process cannot continue until delivery has been confirmed by the tracking number, and it looks like that is never going to happen (again, despite the seller having acknowledged receipt of my package). Seems like I'm pretty much screwed here.
