Would grade EF-45. Just check the right (coins left side) wing for a good check of grade for this series from VF-20 up to AU-50. As the details of the wing become stronger from the body to the tip of the wing for each grade increment it's a pretty precise way of grading the whole coin.
A bit like the horn of the buffalo on the nickel.
I don't like the obverse scratches. I wouldn't buy this coin myself simply because I know that every time I look at the coin those scratches would be the first thing I see.
Plus, when you are getting into that price range you might want to consider a NGC or PCGS. Then you don't have to worry much about grade or damage or cleaning or resale.
