i have never sent anything to be graded myself but I have seen alot of people mention that ICCS will only identify varieties that are published in the front of the Charlton catalogs, but I have noticed that they do recognize the New Brunswick 1864 E/F legend error and I don't recall ever seeing that published in any charltons?

For one thing the E/F is not an error it's a variety.
For errors they have to draw the line somewhere, there are thousands of errors.

It seems to me that ICCS has been certifying more unlisted "varieties" lately. For example, an ebay search of something like "ICCS Double" will turn up many double date or double digit-in-date varieties that I've never seen listed in a published catalog anywhere, particularly in the 70's, 80's and 90's NBU coins.

not to stir the pot, but I also believe the details listed on the label depends on who submits the coin for grading
