Wear on the leaves on reverse and hair on the obverse make me think this is not AU. Milling looks a bit worn also although that may be from the photo. I know nothing about 3 cent pieces (other than that you collect them) but what a great design. I am going to guess XF 45 although I think it has better eye appeal than a lot of coins that would draw an AU.

I must add that there's no apparent luster on the coin.

Sorry. I meant EF 45. I am sticking with that number however.

I've rethought the grade on this coin after buying another (1865) 3CN recently that is an XF40-45. I think it was accurately graded by the dealer as a VF30 although it could go VF35. There's a bit too much wear on the leaves and hair for the XF grade in my opinion. I guess I was following the rule where the buyer sees the coin as one point higher than it really is!
