The portrait appears off as well as the mintmark. The surfaces have a cast look, and the color is similar to artificial toning on counterfeits.

I think it is illegal to sell a counterfeit coin, and illegal sales are not final.

They aren't final but there is a BIG kicker to it. If they deny the refund you have to prove that not only did you buy it there but that was the coin that they sold you. Shady places can simply say they would never sell that or you switched the item on them ect and about all you could do then would be take them to court but again you would have to try and prove something that in most cases you can't

Below is a genuine VAM 3 tilted left CC. On the OP coin the CC is tilted left and the date is in the correct position for the VAM 3, but as noted the surface has a cast look and the color is similar to artificial toning on counterfeits. The denticles also appear off. None of the genuine die cracks are visible on the OP coin. There is also a couple of die cracks in the eye area of a VAM 3 that can be checked that I am certian will not be on the OP coin.

OP, why don't you post the other coin you bought from this Seller. We can let you know if it looks OK. It would be better to deal with the Seller just once more instead of twice.

What tells it for me with fake Morgans is the color. A real Morgan has a strong white aspect to it; a fake one is more greyish.
