To CCF! Looks like damage on the top rim. It's not an error coin. It's Post Strike Damage (it happened after it left the U.S. Mint).

Rextate-
When taking photos of coins, do not hold but lay flat and shoot straight on.
Coins on an angle are hard to determine what the problem is.
Also always include both photos of both sides of the coin.
You don't state what you think is an error so all I can see is
a possible die crack but will need better photos.

Oh, yes, I'm sorry.
The from the "M" in anerica, to the "A" at the end, is cutting into the eagles wing.

At this point, I believe it's a legitimate mint error.

Because of providing a better picture, I believe it's now a legitimate error as well.

Looks to me like a sunken die error, die was broken on the edge there at 1 o'clock

Note the dots, where it broke, and see how it pushed out into the collar(RED arrow)
