Nice coin!
MDS obverse and reverse. Moderate die polishing to reduce clash marks, most noticeable on the "LIB" of LIBERTY / buffalo's right rear leg clash and on the Indian's chin / EPU clash. Remaining unpolished clash marks from the Indian's neck / buffalo's back hair clash and the second feather / buffalo's head clash. Average strike, with weaker central details than peripheral details.
The luster seems uninterrupted. Parts of the photos are difficult to assess because of lighting. The obverse is particularly nice, with minimal bag marks. There are three fairly deep bag marks on the reverse, two on the ground above "N" in CENTS, and a third in the field above the ground between the pairs of legs. There are two minor rim knocks on the reverse at 11:00, and a more evident cambered rim knock at 4:00.
On balance, the obverse is MS-67, the reverse MS-65, net MS-66. I don't see any eye appeal adjustments here. Based on what I see on bourse floors, MS-66 is by far the most common grade for a 1938-D, though I see many that should have eye appeal reductions due to poor strikes. Yours should be a strong MS-66.

Would you be willing to post a closeup of the mint mark? I see a shadow inside the NE opening of the primary mm, and wonder if this could be a RPM.
