I am wondering are these cases easy to open up. As you can see in the Denver set in place of Guam there is a second N Mariana Islands coin. I just happened to notice that. So I am wondering if where I bought it someone had opened it or would it have come from the mint this way.

Is that a set produced and sold by the US Mint?

It didn't come from the US Mint that way, it was assembled by a third party.

That case is NOT a mint issued case - the ones from the mint have a much thicker border for proof sets,
The uncirculated sets came with all the coins of that year in a bubble encased cardboard holder from both mints.

the Quarter sets that were issued in the plastic case were proofs and silver proofs.
Here is the proof set in a case:

and if you were to buy - say from ebay just the uncirculated quarters - it would look like this:

So, No, your set did not originate at the mint, and the person that assembled it, simply placed in the wrong coin in that after market holder - is it an error? well Yes, but not a mint error and no premium can be attached to it.

to the CCF and If it was an OGP, I think they weren't sealed in 09.

Did those sets come with any kind of COA? And your sets are Mint Sets - not Proof Sets.
Looks like the Packaging Boxes may be real but the cases may be off market. It's actually hard finding any info on the 6 coin Uncirculated 2009 State Quarter sets.
