He actually reposted the 1800 after I told him it was bad. Also had a bad 1797 and the mentioned 1847 Seated dollar; reported and all gone for now...

Just an exercise in futility in reporting counterfeits. ebay may throw you a bone once in awhile but they couldn't care less. This 2-Oct-24 (condensed version) ebay has defeated a lawsuit that the US Department of Justice raised last fall, which alleged that ebay violated environmental protection and public safety laws by allowing users to sell hundreds of thousands of banned products. In her order, US District Judge Orelia Merchant agreed with ebay that ebay is shielded from liability for third-party postings (in this case, listings) on its platform.

Counterfeit coins aren't just banned environmental products. They are illegal to sell, hold and transfer across state lines. It is also a criminal offense, not a civil one. ebay can skirt the law but the criminal liability is always there for a federal prosecutor to charge. ebay does appear to make an effort to adhere to the law and does a better job than platforms like Etsy where this activity is rampant.

numismatic student: US District Judge Orelia Merchant agreed with ebay that ebay is shielded from liability for third-party postings (in this case, listings) on its platform. The DOJ is a Federal agency and lost its case against ebay. The ruling can be appealed.

That seems completely reasonable. ebay is a third party sales venue. They can't be liable for the misconduct of individuals using their platform. That would, in effect, convert it into a store where all the products are guaranteed by ebay, and at that point, why allow third party sellers at all? No other sales venues are held to that standard—is a flea market responsible for individual sellers offering fake handbags? The contract is between individual buyers and individual sellers on the venue, and that is where criminal and civil liability must rest. ebay cannot be the expert, authenticator, guarantor, and police of every listing that it facilitates. If you don't know what you're doing, then you shouldn't be spending lots of money buying "valuable" things from strangers on the Internet, plain and simple.
