ok, the problem I'm having is with a coin I recently purchased from ebay. http://cgi.ebay.com/ws/eBayISAPI.dl...TRK:MEWNX:ITI purchased this coin after running it through PCGS verification to make sure it was real. I received the package in the mail this evening but the problem is, its not the coin that is pictured. It is of the same grade and year. However, the coin I received is very unattractive and heavily tarnished. Upon searching the sellers current and past auctions, I have discovered my coin is back up for sale here, http://cgi.ebay.com/ws/eBayISAPI.dl...TRK:MEWAX:ITin addition to having been sold at least 3 times before with the same serial number. In each auction, the item description says that the buyer will receive coin pictured. Upon contacting the seller, he says that he has several and they all look the same and that the picture is just a representation. He also said that I can look at what he has and pick one if I like. I responded saying that these are serial numbered items and I wanted to know where my coin is. He has yet to respond. Am I wrong to want the coin that is pictured? What should I do?

Surprised he has 100% feedback still if he did it to a few other people as well. If it's serial #'d to a specific coin that is what you should receive.

Report to ebay at once as coincollector123 stated, item is not as described. I be surprise that the serial number are the same as pictured, and if it is, you have a case.

The auction clearly states "THE COIN YOU SEE IN SCAN IS THE COIN YOU WILL receive (sic)" - you are owed a full refund plus return shipping. If he won't do it (and I wouldn't send it back without receiving the refund first) then report him to ebay. Your expectation of receiving the pictured coin is correct and stock photos are against ebay policy (even more so when they claim it's the photo of the item). The only reason not to rat him out first is that it may be less hassle if you can just get him to agree to refund you.

I would settle for nothing less than the coin pictured or a full refund (which ever you prefer). If the seller cannot meet this request I would report him immediately. I hope it all works out for you!

keep trying with the seller, and always send communications through ebay.. not your private email.. ebay has access to all communications now - they can go through all your messages and see whats going on in a dispute if it comes to that

I hope the seller replies tomorrow. According to his feedback, he has 100% satisfaction from his buyer's. I want to believe that this is just an honest mistake but I have found 5 auctions now that are all the same serial number along with the phrase "coin pictured is what you will receive". Not to mention he has my coin posted on a current auction right now with two bidders. I think I just need to sleep on it. Hopefully tomorrow will be better.

It's completely obvious it's not an honest mistake. After investigating I can honestly say I would stop all correspondence with him immediately and file a SNAD with ebay. All communication with him now would be through arbitration. He needs to learn a lesson. He's been on ebay long enough that ignorance of the rules is not an acceptable excuse any way.

If he is using a stock picture and claiming you will get the coin pictured but then sends a different coin, you are almost certainly NOT going to get that pictured coin from him. There is a good chance he doesn't even own it either haveing used someone else's picture or having shipped that coin out long ago. If he doesn immediately agree to either sending the pictured coin or a full refund including shipping, I would file a significantly not as described complaint with paypal or ebay which ever it is, and probably report his use of stock pictures of a serial numbered item with ebay.

No matter what you do, try to remain civil in your correspondence. Don't let him use "they were belligerent" as an excuse why it took so long to resolve the issue.
