Help! I'm About To Get Scammed And Slammed - Advice Needed!

I sold a restored 1913-D T1 to a guy in NJ. A couple days later he wrote to me (in very broken English) to say that it was not the same coin that I listed on ebay (he said the date was missing!) and that he wanted to send it back and he wanted me to send him the right coin.

He only paid $12.61 for the coin, and my shipping is FREE, so I bit the bullet and told him I was sorry for his disappointment but just keep the coin and I'll give you a full refund.

He wrote back that he already put the coin in the mail and that he did not want my refund. He wanted me to find and ship him "HIS" coin. He said if he didn't get HIS coin he'd report me to ebay.

I told him that I would wait for the coin he was sending me to come back and then I'd begin my investigation.

His coin came back today and when I looked at it, my first thought was that he was right and that I had sent him the right coin. But then I noticed that the coin had been removed from the holder and placed back into it...poorly. I pulled up the photos of the coin I sold him and then I realized what was going on. He had buffed away the date and some other features, but all the other landmarks are still on the coin! A scratch on the Indian's chin and another in the field below the buff's beard...just for starters! There is no doubt that this is the coin I sent him!

So...I went to PayPal and gave him the full refund anyway and I even PayPal'ed him .88 cents for the two postage stamps he put on it. Then I wrote him and told him that I can EASILY prove what he did and that if he does ANYTHING other than give me a positive feedback I'm reporting him to ebay's security department.

I don't know what good, if any, that will do, but I felt like I had to do something.

Is there anything else I could have or should have done...?

Here are the exact, word for word email conversations I've had with this man. They're organized so that you can read from the top down:

hi. this is tinos210 I received the buffalo coin and you sand me the rowing coin, the one I bid on have nice date swoing and you sand me one with no date atoll, please send me a coin 1913 d to have a date showing, if not I will contact ebay, I will return your coin . at once .thank you

Hello tinos210. I am very sorry that you do not like the coin. I do not have a coin to replace it with, so would it be agreeable to you if I gave you a full refund through PayPal and allowed you to keep the coin at no charge? This way, you do not have to go through the trouble of sending it back. Please let me know if you are agreeable to this and I will send you the full refund. Thank you. Steve

At any time during this process if you should change your mind I will gladly give you the full refund plus whatever it cost you to return the nickel to me. Wow. I simply don't understand some people...why? You strike me as being more than willing to work with this guy. I've dealt with people like this--where a firm, unwavering position works best for me. Some people just get a rise from messin' with ya.

Now I feel better that I've limited my coin sales to CCF and friends.

He probably realizes that you will not be able to find another "date restored" coin and, hence, will have to buy and ship him a regular one which is much more valuable.

You need to get in contact with the ebay fraud department, send them all the pictures and evidence you have that he doctored your coin and shipped it back. Hopefully, they will shut this punk down and remove any/all feedback he has given.

Oh, trust me, I could BURY him under date restored 1913-D T1's. I'm pretty sure that's not what he wants. You're right though, he probably does want me to send him an original date.

Wow, sorry about that. This guy needs to be blocked!! Unfortunately, time and again, ebay sides with buyers and I fear that if this goes to ebay for investigation, ebay will side with the buyer. I hope that ebay, for once, will prove me wrong!

This guy is a crook and trying to scam you. I don't get why he doesn't accept the refund though! He had a chance to keep the coin AND get a refund!

I online chatted with ebay. They say there's nothing I can do until and unless he NEGS me or threatens me with a NEG. They gave me some links where I can appeal if that happens. I'm NOT encouraged...

OMG...this is CLASSIC! Look at what he wrote AFTER I told him I would report him to ebay if he negged me:

Do all communications through the ebay message system so they have access to it.I added this guy to my blocked buyers,thanks for posting.

What a kidder. Anybody can read between the lines and surmise his intent--imo. How are you going to get this guy to focus long enough to drop his ridiculous claim and move on? This got my attention because people like this a constant challenge to conducting even-handed business, something I pride myself with collectors here, as with my clients.

I think he's trying to make me think he's Hispanic and that this is the extent of his grasp on English, even though his last name (am I allowed to type it here?) looks to be GREEK and not Spanish/Latino.

Judging by what he's selling. I suspect he's deliberately lazy with his writing so he'll "not understand" you when you press the issue w/him. Too predictable.
