Those photos aren't very good...too much reflection and washes out the details. I'd have to say VF+. I'd need to see the wear on the cheek better along with the overall wear on the reverse.

I'm a little confused with the striations on the reverse columns of your coin. (Maybe it's the photography?)
Yours look diagonal versus the vertical ones on this coin:

yes my digiscope is old and the quality of detail is low in the pics. the coin I have looks like the one you posted with the columns, mine have full spread with no wear like that one

I took it to 4 coin shops, one of which the owner worked for a grading service years ago and all gave it a grade no less than EF40. Thanks for all the help :O)

This coin has the detail I would consider for an EF-40 grade. (I don't see that on your 3 cent. Again, it may be the photography).

I would grade yours VF-20.
