The article I read said the SMITHSONIAN coin department doesn't even have one and the treasury declared it illegal to own them so how do you know if whats for sale is real?

You are missing something completely fundamental here. What you're linking are grades, not dates. There are no 1964 Peace dollars for sale.

I believe the mint was embarresed about how they messed up their minting all the way, and then melted their product, so they were not reminded about it.
