I'd go VF35 on this one. The scratches would more than likely be considered, and warrant a details grade.

I'd go just a bit lower: VF-25 details max. The obverse digs and reverse scratches are severe enough to constitute a damaged/details grade. There may also be some corrosion developing with the upper reverse being the area most affected.

I'm with Jaobler at VF-25, also some issues with the surface, the scratches will make this coin go details at a top TPG company.
