Tough call from the photos, I really need straight on shots where the entire coin is in focus. I am seeing something strange around the 1:00, 5:00 and 7:00 areas on the obverse (scratches)?

The coin could go AU55 or MS64 I think. The change in colored areas on the coin leads me to believe it was restored at one time, and possibly recolored to hide the fact, I could be wrong though.

These scratches between the date and the UNITED looks like a graffiti to me. Someone has engraved something over there. Color doesn't look right to me either.

So yes, MS details.

Scratches between the date and America, also above the headdress. Definitely recolored.

And IF it graded it would probably be RB instead of Red.

Yep I doubt it would grade clean at a TPG would get details for graffiti/scratches and probably recolored or altered surfaces most likely.
