Mod, this kinda tails to my previous thread, but imo the topic is different, and wanted to get some fresh looks. Please move if appropriate.

My buyer finally opened a case ( I actually encouraged him to last week) for not receiving an item that the PO has apparently lost. It's been more than 4 weeks since last tracking. So what happens now? I don't feel I'm at fault, so am content to let the next 6 days go by. So what happens when seller escalates case to ebay? Do I get my day in court, so to speak? Thanks, Ed

I know other people mentioned in another thread you will be covered, but that is not generally true.

More than likely, buyer will be refunded from your account- I believe if you check your paypal, funds will show up as being 'on hold'

More details needed. Are you covered by PO insurance? Have you filed a tracer with PO and what do they say?

Did you ship it with USPS tracking ... and if valued highly enough signature required upon receipt and insurance.

There is a big difference between a $10 ebay loss and a $2000 ebay loss ... what magnitude are we talking about here?

For me ... if it's $25 or less I would refund the buyer after some discussion on positive feedback and simply move on.

jdmern linked the other thread. Not high value, $86 to be exact. No insurance, and yes, ebay notified me that my paypal funds will be on hold. Yes, I did file a tracer, and the USPS traced it as far as the tracking stated. I got an official looking document from my Post Office that shows the PO can't find the package, and my Postmaster signed it and stamped it. That's my hope, but not sure if there's anything I can do if ebay automatically refunds from my account. Hopefully I'd get some say in the matter when buyer escalates. I'm going to sit tight for the time being. Just can't see volunteering a refund because of PO mistake. If ebay takes the money from me, so be it. Yeah, if it was a small dollar item, I'd probably just refund it.

I'd speak with Paypal directly and explain your case. If you have a strong record as a seller there's a good chance they will refund both you and the buyer. This is far from unprecedented and at times double refunds are issued. My guess is eventually either you or the buyer will receive the item and I hope either party would "make it right" with the other and ebay at that time. Have you verified the address(es) on the shipping label you printed? Good luck.

I am pretty sure you should be covered under Seller Protection. It sounds like you followed all of the requirements. I think the buyer gets refunded first and then ebay reimburses you.

Buyer always wins. Trick is to balance the cost of protecting yourself versus the cost of not protecting yourself. Always insure unless sending Express Mail or Registered Mail.
Rest in Peace

As simple as Frog makes it sound, it really is that clear cut.

ebay only cares if the buyer received their package or not.

If you are covered by postal insurance (you get $50 coverage with any tracking) the PO will cut you a check for the amount of insurance for the lost package.

If it were me, I'd refund my buyer with no further nonsense with or without what ebay has to say.

If you were the buyer waiting all those weeks for a package and you had to escalate the complaint because the seller won't refund - what would you think?

It's reslly easy - if the BUYER showed up saying it's been six weeks and my packsge hasn't arrived, even the seller admits the trscking shows that and the seller won't refund? We would all be saying open a case and neg his fanny!

If you do nothing, and ebay closes the case I believe you will get a defect for an unresolved case.

Yep, as I say, Buyer always wins - this is a cornerstone of ebay. It is so easy for Sellers to protect themselves, and I am always surprised by their indignance when a problem arises.

I just refunded the buyer. Enough is enough. You all helped a lot. And yes, you do get a strike if the case doesn't resolve.
