Lawsuits Against Ebay For Facilitating Sale Of Counterfeit Items

Reading recent posts here about repeated counterfeit listings by nefarious ebay sellers--and ebay's lack of a meaningful response--led me to do a little research on the topic of lawsuits against ebay for facilitating the sale of counterfeit items.

Tiffany lost a lawsuit against ebay, a case ebay apparently cites often since the 2008 decision. Tiffany Inc. v. ebay Inc., 600 F.3d 93 (2d Cir. 2010) (Wikipedia)




French conglomerate LVMH sued ebay, but recently settled. Louis Vuitton parent, ebay settle 8-year old fight over knock-offs (Fortune magazine)

LVMH, which owns high-end brands like Louis Vuitton handbags, Tag Heuer watches and Dior perfumes, sued ebay in France in 2008, arguing that it allowed a vast trade in counterfeit goods. To hammer the point home, it said that the majority of its branded products listed on the online marketplace were, in fact fakes. Later that year, a French court ordered ebay to pay 38.6 million euros, saying the company hadn't done enough to prevent knock-offs from being sold on its site. That was followed by years of appeals and fines and other related suits.

Notwithstanding, the same or similar fake products continue to be listed on ebay.com. This despite the fake sellers using colors and materials in their products that the plaintiff does not use, and despite the fact that the plaintiff does not sell its products on ebay, nor does it allow its licensed sellers to do so.

ebay claims "You can't list replicas, fakes, counterfeits, or other illegal copies on ebay"

Nevertheless, The Counterfeit Report® received over 2,000 counterfeit products1 from ebay sellers, representing over 400,000 counterfeit items listed or sold to duped ebay consumers.
A Press Release identifying the particularly alarming sale of fake FBI, Police badges, and identification made-to-order on ebay was emailed to ebay CEO Devin Wenig. The email was viewed 302 times, yet six weeks later, the ebay listings remain. (continued...)

Absent a multi-million dollar judgement, ebay is money ahead by business as usual.

All the lawsuits are brought by copyright holders.

Coins have no deep pocketed company to sue ebay.

Very true, although I thought The Counterfeit Report did a nice job conducting actual research and providing a detailed report. Whether it leads to changes or not is another question, but at least someone is trying to expose ebay's negligence. (Along with members of CCF, of course. :o)

Sure, it's old news to you, but not to those of us new or returning to coin collecting.

Cynicism has its place, i.e., it can protect us from exploitation. It can also come across as condescending and critical when voiced in direct response to another person's effort to share potentially valuable information.

dd27, thanks for your post. It helps put ebay's indifference towards counterfeit coins into perspective. It seems to me that counterfeits are so prevalent now that even if they wanted to, it would be difficult for ebay to eliminate them and still maintain their open market business model. Although I guess they could do a lot more than they now do...
