au58. looks like some breaks in the patina, especially in the reverse.

There are no breaks in the luster. It just toned around the details which can give it that appearance in a photo.

patina and luster aren't the same thing. there are visible scratches and marks which means that the luster cannot be unbroken.

I think there is a slight rub on some high points, I'd say AU-58, but so close to MS.

Just because there are scratches on a coin doesn't mean that the luster is broken. That would mean that all coins that are not MS-70 have broken luster, as the coin would have scratches.
However a coin with toning can sometimes have muted luster.

I would grade this coin AU-58, but it is almost MS.
