I think I see enough detail loss to rule out an original MS grade; I'd call it AU-58 in terms of wear. At a guess I'd think ANACS would "net" it down to EF-40 or EF-45 at best. The hairlines on both sides are quite obvious.
For the record, I bought a raw MS 1857 flyer years ago that was net-graded to AU-55 by ANACS. That coin I believe was a true MS and had no hairline scratches, but had apparently been dipped which gave it an odd color. I sold it on Teletrade where it fetched $240. Your coin is more seriously impaired so the net grading should be more severe.
