Can't tell if some of the marks are on the coin or on the holder. I am seeing MS64-65 because of some marks in the buffalo's front leg and shoulder, but I'm guessing you bought this because it has a ridiculously high grade on the holder. Coin looks great and the obverse looks fabulous. Is the mintmark doubled?

If this was a 1039 D Buffalo from the Middle Ages, it would be worth a pretty penny.

I dont have it in hand, just won the auction, to me it looks like the superficial scratches are on the case, and I fixed the 1039, thanks for the catch.
Pictures are not great, ill post in hand pics before reveal, give a chance to revise guess.

Bit weaker than average strike. Can't tell if the luster is subdued or it's just the sellers pics. I'll say MS65 FS-514, nice OMM

MDS obverse and reverse, slightly soft strike. There are a couple small divots and some high point surface scratching. It looks MS-65. The standard default grade for 1938-D Buffs is MS-66, since they were saved in bag quantity, and I wouldn't be shocked by a 66 on the slab. (Mint bags and rolls were common at shows in the 1960s and early 1970s.)
I can't get a clear enough view of the mm to determine variety. It looks like a split serif and something inside the primary mm, but I can't see it clearly enough from the seller's photo. I'm thinking either RPM-005 or FS-512/OMM-002.

This is the played with photo I used of the OPs pic. Not great, but it's something. Can make out the split serifs from the RPM and what looks to me like the centered S serif. MM position looks correct as well. Sticking with FS-514 OMM-004. Wouldn't be the first or last time I'm wrong though @ farrider, did PCGS attribute this one?

Weak strikes , not a coin that has great eye appeal . If all scratches are on holder , MS-65 .
