I'm in the middle of a dispute over a coin I purchased on ebay. It is an 1886-S half eagle described by the seller as "great condition....looks like mint condition". I didn't really expect an MS gold piece but based on the mediocre photos I thought it might be a decent original EF to AU coin. It was offered with a 3-day money-back return privilege. When I got the coin it was obvious it had been shined up, with a glossy unnatural sheen over light wear. I immediately contacted the seller and told him I wanted to return it for a refund. His response: "glad to hear you picke up the coin..but sorry can't take it back...for what I know the coin never was cleaned.and it's original and I bought it from the goverment few years ago.it's circulated and I think the condition of the coin it's good.." (Pure Shakespeare....but I digress...) I replied that I thought he was obligated to honor the return privilege and he did not respond. So, I filed a dispute with ebay. Seemed like an open-and-shut case to me! ebay eventually reported that they had made a final decision in favor of the seller! Say what? I appealed this decision, pointing out (again) that the coin was offered with a money-back guarantee. Today ebay responded, saying they had reversed their decision and I would be getting a refund! That's good news for me, but I'm wondering how they go about making their decisions. I mean, I fully described the situation in my initial dispute filing and there are no new facts to report. Are they randomly choosing the winners in disputes? Has anyone had any kind of similar experience? By the way, I emailed the seller again and politely told him I would return the coin after PayPal confirms I got my money back, and would he please send me his mailing address. I haven't heard from him yet. I've only given one negative feedback before but I think this one calls for neg number two. Am I being too hard-hearted? I think this calls for several "ummmms".

It's a "Neutral" feedback at best and that's only if the seller starts communicating to get the return moving...
I have a feeling it may end up being a "Negative" though....if the seller doesn't cooperate post haste...

Nah, I would definitely leave another negative. The guy sounds like a real piece of work.

How did he buy a coin from 1886 a few years ago from the government? Confusing! Sounds like a few cards short of a full deck!

His return policy section is obviously from another auction, I wonder if he thinks he stated no returns in the listing.

He tried to swindle you. What kind of seller offers a return policy and then renegs on it? He doesn't have a choice -- it's a three day return policy he posted. He tried to breach a contract. Fry him.

Wow, I guess I'll stick to my gold buying policy. Mint or in person. Glad ebay went with you though. They'll get you the money, especially if you used Pay Pal. Keep us posted on your progress please.

A lot of sellers think they can just ignore people and they will go away...sadly it works sometimes.

The plot thickens.... The seller responded to my latest offer to send back the coin, saying that he thought the issue was resolved in his favor and that he had the money so he doesn't have a problem. Meanwhile, ebay has paid a full refund of $327 into my PayPal account as of yesterday. They also sent me a new email saying the case was closed. Does anyone believe that ebay would just fork over cash and not expect me to return the coin? I would certainly expect them to hit the seller for the refund amount. Like, immediately! More ummmms:

Negative feedback is in order ! He clearly violated his own money back guarantee.

Sure, there was an address on the package but I wouldn't just shoot the coin back, without a confirmation from the seller that a) he agrees to accept the coin, and b) the address is correct. That confirming email will be added to my collection of emails from this transaction. That collection plus my mailing receipt with delivery confirmation will protect me in the event that he later claims he never got the returned coin. I'll keep all my emails in my ebay folder for at least a couple months after it's all over. Of course, I won't be doing any more buying from this character.

there is one flaw I read here. ebay will not refund your money until you can prove you have sent the coin back. So there is no way you will get your refund and then send the coin back, you have to prove to eBay/paypal that you sent the coin back (with signature confirmation, not delivery confirmation) and once you have that proof they will issue a refund. This is how I have always seen it work anyway, I have never seen anyone get a refund and then them send the coin back. That is a seller only option there where they get their money before you get your product

Jaobler is saying he got the refund already, so I guess ebay's policy is not consistent. Did you send the coin back yet, Jaobler?
