Hello, in may I had sold 150 irish pounds on ebay to a customer in ireland. The customer claims that he never received the coins and is accusing me of not shipping them, despite the fact that I have proof that I did ship them. He has opened a paypal case against me and as I've never had a case opened against me before I'm a bit unsure of what to do. Should I contact the postal inspection service regarding potential fraud? Is there any chance that paypal will sieze funds from me, and if so should I take them or the customer to small claims court to try to recover them?

Any advice is greatly appreciated,

Go to PayPal or ebay and look at the Seller Protection program they have. If you have everything they need from you showing that it was shipped and delivered, you should win the case. Delivery proof is going to be the key. I'm not sure if they will hold funds, but they should have answers on PayPal.

Did you pay for Proof of Delivery or have Insurance on the package?

Since it was an international delivery, USPS wouldnt do delivery confirmation. I do have a customs tracking number, but it doesn't show anything after the package left the USA.

If you can prove with paperwork that you mailed the package and followed all of ebays rules, then the ebay protection program should refund the purchase price to the buyer and not penalize you.

Ow. Check with ebay and PayPal on Seller Protection. If you can't prove delivery, it doesn't sound good. Sorry to say that.

This is why I don't ship internationally. Nothing against our friends outside the US, but once it leaves the US, anything can happen. Good luck...

It takes more than proof of mailing to win an Item Not Received dispute. You must have proof of delivery (Delivery Confirmation) and if the transaction is over $250, you must also have a signature (Signature Confirmation).

From the information you've provided, you will lose this PayPal dispute. You'll be on the hook for a full refund (including shipping).

Xavier : Nowadays a lot of strange things happening in the post. Your buyer may either intentionally doing this, or cross-Atlantic post is having major problems. Two of my parcels outbound to the US are missing, two packages with LC (CN-22) tracking numbered packages are also missing from the States to me. Mostly, LC packages are delivered with signature in Europe, however, I have no idea what's wrong nowadays. Back about six months ago, I receive about two packages or letter size items from the States to here, with one losses per year, or one per two years.

The user's name is Garymac27. I had told him several times that there might be major delays through customs but he simply kept stating that he did not have his package. I talked to paypal and they moved it to a claim, but also told me that it likely is still in transit due to customs delays. They also informed me that they indended to give him the money if the tracking number showed that it hadnt been delivered by July 11th. I asked what happens if the packege shows as being delivered after the 11th and they stated that there is nothing they can do and that there would be no way for them to give me my money back. It looks like a small claims court case is brewing.

The only package I've ever had claimed as non delivered previously ended up being returned by the usps to my house due to a bad address, but the buyer gave me a new address and it ended up going through ok the second time. I checked the address of the package with the buyer and he said that it was fine, so I really dont understand how it never arrived.

Sorry to say that small claims isn't the answer either. Paypal is simply applying the policy you agreed to contractually. Even if you can file against an international customer, you'll likely win a default judgement, but will not be able to collect. The only positive outcome for you seems to be to hope the package arrives and that the customer is honest and then pays for it. I had a package from the UK to PA take 62 days. It arrived well after the refund was received, so I just contacted the seller and paid. Sorry for the bad experience. Good luck.

Well the fellow does have a paypal account, so I suppose I would be able to seize the assets of his account since paypal is headquartered in the united states.

Bah Paypal just settled the claim in favor of the buyer and stole my money, looks like smalls claims court is a calling unless there is some other method of resolution I can use to retrieve my funds.

If you insured the package usps should pay you for the lost package.

You can take paypal and the usps to smalls claims court as well. If he did not receive the package, its usps's fault.

Paypal / ebay just makes me mad- they always seem to take the side of the buyer. Its very hard to win almost any case as a seller. Honest Sellers are ready to revolt over the nightmare that paypal has become.

Most can't wait for google checkout to expand in earnest for some real competition, of course the first thing paypal did was to sue them in order to stall.

that is exactly why I do not sell to anyone outside the US. I have heard allot of people on here complain about sellers that do not ship to their country but if they would read cases like this they would understand. I really hate this happened and there is really nothing you can do to get your money back nor the coins and I really have no idea how you could ever protect yourself from this type of thing when you do ship internationally like this because once the package hits customs and leaves the US the paper trail ends, which really stinks
