I hope for your sake I'm wrong but a little while back quite a few 1939 roo halfpennies popped up with funny looking lustre. It was either dipped or painted some how. Yours look eerily familiar. Here is a link https://goccf.com/t/108740 from back when I joined CCF showing the one I purchased. I later found this one to be one of those with the fake lustre. It just didnt look right and two dealers here in Adelaide agreed it was dipped or something. I have since seen several on ebay more specifically several from the one seller, dodgy? I think so... I hadnt seen a any for a few months until now. If its genuine lustre (and I really hope it is) then it looks at least EF.

The more I look at it the more I cringe. Fingers crossed though!

I know these ones with lustre can look a bit off if not photographed properly as I have a PCGS MS63 example that looks exactly the same as the one above in a particular photo of it

Lustre can be a tough thing to photograph. I'm just suspect of this issue in particular due to the number of strange looking ones I've seen. Hopefully its fine, probably will be.

the only real detracting marks are the marks behind the kings eye otherwise in my oppinion I would put it at aUNC/UNC at least

There's no lustre evident in the photo so either it's been cleaned or the photo is hiding it, in which case the photo would hide any fine detracting marks too. I personally wouldn't buy a coin from such a photo because it leaves too much to chance - the coin could be anywhere from a cleaned gVF to a nice UNC.

gVF maybe aEF, looks like this has been cleaned (brown spots on reverse) and darkened areas on the fields. Uncleaned would go AU55-AU58. You can't win them all Steve old mate

I think I'll reserve judgement until I see it in hand
