At this level it really needs to be viewed in-hand. Could easily be a 65 but the new photos look semi-PL or possibly even polished.

I don't have the coin and these are seller pics. Honesty this coin scares me, I don't want to get burned if it has an issue or if there is some hidden circulation wear.

If the price is right and the seller allows returns then go for it. How much do they want? Did they state why it isn't already slabbed?

Are those mint marks the same in both pics? Optical illusion perhaps... Prob the same

I'm still at MS64+ on this one, though an in hand inspection is a must, gold is a very soft metal and a tiny rub would go unnoticed in photos like these. The only obvious marks I see a very light contact mark on the chin. I think the rims look okay now from the original shot, but a coin like this really can't be graded from a couple of photos online properly. Get a return guarantee before committing to it, and I'd only get the coin if it were from a long time dealer with credibility, otherwise there are many other dealers out there. You get what you pay for, not to be nosy but is the dealer charging MS63, MS64 or MS65 money? There is a significant difference in value, and for you to put your trust in them they need to have a great track record in selling and buying coins like this. Can you perhaps have it submitted to PCGS or NGC after you get it, (Knowing the time frame will be much more than 2 weeks) and get either a partial refund if the grade doesn't come close, or a full refund if the coin is not genuine? Now if the coins is sold as a MS63 and comes back MS65, would you then pay more? Tough call, if it were me, I would not do the deal unless it was face to face and the coin was in my hand for inspection, and I know a little about gold, probably more than the average collector, but not enough I'd feel comfortable in calling it a MS64 vs. MS65+ It's any where from an AU at $520 to $2725 in MS65 where does the price you are being offered fall in that range?

The slight disturbances on the reverse fields would not preclude a gem grade and the rest of the coin is "all there".

Tell the Seller you want an extended return so you can send the coin in for authentication and grading. If he does not agree then YOU then know that: 1) it's already been sent in; and 2) it has problems.
