First two letters of his ebay name are right on in my opinion

You should be able to place a claim almost immediately and choose "not as described" Give him appropriate feedback as well. Don't sugar coat it, so others can avoid the same scam artist.

In the claim state that you had the coin looked at by a group of resident coin experts and it is in their opinion that this coin is not authentic, and possibily a cast/copy/duplicate of the original.

Probably an Alibaba coin. It's counterfeit, no doubt about it. Don't let him get away with it or he'll get more.

Notice that he listed it as a "poor mans" doubled die. Sounds to me like he knew it wasn't "the" 1955 DDO, but it's not a "poor mans" either, since that is a real coin with some Die Deterioration. Regardless, it's not what he claimed it to be, so you should try getting a refund through ebay.

he seemed to write up the ad as if he didn't know what it was, allowing individuals to "take advantage of him/her" and, should there be a claim against them, simply plead ignorance or like they didn't know any better. If a person knows the "poor mans' doubled die" reference, they should know the difference.

You never know if people like this have a production line down in their basement. They sell junk but have top of the line merchandise locked in their safes. Like a judge will probably say, ignornace has no bearing on the law. They get paid via an electronic chain of evidence, provide pictures, emails and writeups under their own free will knowing that the item they are about to sell is unethical and potentially counterfiet and seem comfortable with it. They live the high life until the Feds halt their happy times and then, adapt to the life of wearing orange for a while. =\

I suggest waiting until the coin arrives, to see what he actually sends. I like copying the pictures of the coin in the ebay ad to my hard drive so I can compare to what comes in the mail.

If it doesn't look like an orginal 1955 DDO, open up a case, ensure you choose "not as described" as I posted earlier.
If the seller tries to send a "cancel" the transaction, decline it. The devious ones know that a transaction that is cancelled does not allow you to leave proper feedback. ebay then typically will not get in the way, unless the refund takes forever or the actions between buyer and seller go sour.

The "product not as described" is an automated feature and ebay will not intervene unless it takes longer than a set amount of days. You CAN call ebay and start the process over the phone, and a live agent will document the case.

If the seller mails you a counterfiet coin, they are subject to mail fraud in addition to other potential charges. Its up to you how you want to handle this, but, much like many other collectors - people don't want a fellow collector to fall victim to this guy - or any other - that appears to do unethical practices.

I don't understand why the seller is being blamed. He said they never sold coins and it was not listed as DDO. I say you keep it and don't return the money as a lesson from that one time you biught an obviously horrible fake.

I still feel like a newbie....lol

thanks everyone for your help... this board has helped figure this out... without this boards help I am sure not just me hundreds of things like this would happen.... As I know you do report items and sellers all the time.

I contacted ebay, reported the item and contacted the seller he said "well I'm not in to coins that is why I listed it as poor mans if you dont want it I am refunding your money I will take it to a dealer here and see what he says refund is being sent if the dealer says it is ok I will keep if not he will destroy it"

then responded a second msg

"hello your refund has been sent.i will be taking it to a dealer and have it authenticated,i will see what they say thanks."

Poor man's double die, authentication? Looks like one of those 4" castings painted brown (look at that banana nose)! I'm glad you are getting your money back Ocala - but you may want to slow things down. You've come a long way in a short time, but this isn't a race unless you make it one. Find a safe pace for yourself and keep your $$ for yourself. Too many out there willing to sell snake oil.

Life in general is a learning experience. He can say what he wants to about what he "plans" on doing with that coin, let just hope he follows through.
The dealer can't authenticate it, its more his opinion. Once the dealer sees that coin, I am sure he will be in for at least a good smirk.

The seller may just be simple minded, didn't know any better. But in this day and age, there are a TON of counterfiets of anything worth a lot of money.
NO MORE Ramen noodles for the week ! Go buy yourself a steak and potato meal, you did good by following through !
