Nice pics. I believe the reverse of 1938 has wavier steps than your coin does.

Sorry this it is not an 1938 reverse.

Here you go - something the grading companies seem not to be aware of since they use the steps in their descriptions as to how to discern these. Thus unless the coin is in great condition you cannot always tell using their method:

I read the same description as in Earle42's reply. The steps are the only area not sharply defined. The rest of the coin is in great condition for a circulated coin.

To complete this: The proof 1939 are type I. On 1940 on nickels circle type I is considered scarce.

by that measure, the lack of an S serif on the OP's coin means it is the reverse of 1938

@Nick10 you have to look at the "pluribus" and on this coin it is the sheriff.

I don't see one there, maybe a closeup is needed.

I was asked to take a close up of the "U and "S" in Pluribus. I don't see a Serif.. Type 1?

If you look close you see you have an MD here, so the sheriff is stomped. We will see what others will say. Maybe I am wrong in my observation.

nice closeup, looks like non-serif to me, and the S has the chunkier middle body of the reverse of 1938

Rev of '38. No serif. Find one with a serif to compare side by side. The serif is typically very obvious. Zoom the graphic.
