This is a ground find - details, cleaned (should have seen it before), ED, yada yada yada.

Unfortunately I'll say because the coin has minimal wear. I know one of the 36-D markers is the back leg fading out into the base. This seems to meet that requirement. Any other markers you can share?

Or just a definitive NO on 3.5 and I'll cull it.

I have a few of these things and one of the diagnostics I've used over the years is a slightly tilted mintmark in addition to the abraded front and rear legs. I think it's the real deal!

Your coin is in pretty bad shape but still might be worth a trip to ANACS for TPG evaluation. (Especially on a grading special!).

I thought that the abrasions were attributed to the 3 legger not the 3.5 legger..

and for the 1936 this mint mark location does not seem to be in a known location for this year...

MM location looks good and really close to PCGS images but could be a little low. I'll throw it back under scope for some crisper photos of MM to make sure all shadows, etc... are removed.

OK, your image is a bit fuzzy and zoomed in a bit more than the PCGS example, but I think there is a visible drop in your MM compared to PCGS.
