Bad Paypal Experience

So I bought 40 AU Morgan dollars from a guy (I met him on ebay). We settled outside ebay for a better deal for both of us. When the coins arrived I opened 2 odd looking airtight holders for 20 $1 coins each only to find 40 Ike dollars . I emailed the seller and advised him I think there is a mix up and that I would be opening a paypal claim. I also told him I'm not opening the paypal claim to screw him, just so its on record as soon as possible. He did not even reply my message and simply stating on the paypal dispute that he sent 40 Morgan dollars and he was afraid this would happen. Any ideas on how paypal will resolve this? I didn;t think I would get the response I did. I was hoping for, "Oh my mistake, I shipped the wrong tubes. your Morgans are on the way." Now I feel I might be had.

I don't know if this is a bad ebay experience or bad pay pal but with no response from the seller I feel he has left you holding the bag without ebay repercussions.

I hate when people kill deals like that for other people. This why nobody can TRUST anybody these days. I would love to try to make deals outside of ebay cause of all the fees but I totally understand why people wouldn't want to do that. I definitely am an honest person and don't need to scam people but nobody over the computer knows that. You never know who you are working with. I personally be very hesitant to do outside of ebay unless there was some insurance for me.

Such a Shame. Hope you can do something about it.

Once you moved the sale away from ebay, you lost all your buyer protection through them. How were the coins shipped? If the shipping details have the weight of the item, it should show that the package you received was 5.7 ounces too light. The total weight of 40 Ikes is 32 ounces. The total weight of 40 Morgans is 37.7 ounces.

I called the post office and found that if the package was sent with delivery confirmation, there is a chance that the post office weighed the package when he sent it. If you have the tracking number, call your post office and check if they have a weight on the shipment recorded in the tracking details. This may be the only way you have to prove that he shipped you Ikes and not Morgans.

Good luck with this and let me know what you find out.

You're toast. As far as Paypal knows, you sent him that money out of the goodness of your heart - you can't even prove a transaction existed.

Like Yokozuna stated, Ikes weigh less than Morgans. You should also request your Post Master to weigh the opened package as received to document that the weights match. It would be in your best interest to contact the Postal Inspectors and file a complaint through them as well as the Attorney General's office in your State and the State of the seller.

Also, PayPal is required to be a registered Transmitter of Monies (or similar) and is thus a State regulated banking entity in each State it operates in. You should make an inquiry with your State's regulator for advice on how to continue with your PayPal dispute given the current situation.

Once You decide to go off E-bay and conduct the transaction privately on your own with the seller, it's "buyer beware!"

That is preponderant proof a contract existed. The seller admitted to its existence. A court or inspecting authority would have to determine the exact details of the contract. So far, the facts indicate an admittance of the existence of a contract, the admittance filed in reference to the payment method, and the physical evidence of the received package.

There's plenty enough evidence to support the buyer's claims.

I paid with paypal echeck meaning I still get paypal's protection. I also called paypal and they said they are waiting the seller response since he is the one who escalted to a claim and then they will go from there.

That's kind of a large deal. If you had paid cash it would've been a different story.

Perhaps you should wait until the issue is settled one way or the other but I hope you can identify the seller for the benefit of CCF members. Unless he makes good on the deal potential buyers need to be made aware of this bad apple.

You sure saved by going off ebay didn't you. Oh and if you tell them you took the deal off ebay to save money (like you told us) you also risk having your ebay account suspended. Whether paypal will agree to repay you or not I don't know. I hope so for your sake.

If all goes bad and the seller still refuses to make good I will definetly let his username on ebay be known to anyone who wants to know.

Ouch. I can see where doing a deal with someone you met on ebay might cheese ebay off. I don't see how that negates any protection you should have under Paypal unless it was a gift transaction. If I bought from someone here, or any other online source, & paid through Paypal I'd expect them to honor their buyer protection agreement.

This does bring up an interesting issue. The package is delivered but without the correct merchandise. How does one prove what has been received without witnesses or video tape opening the box.

As suggested above I got a box from the Mint today and it does have the weight on the label. It was sent UPS though.
