so was on my way to buy some coins today and got stopped by the police. when the officer saw my little scale in the seat next to me he asked why I had it. so I explained it to him, to my surprise he says well this time ill let you go but from now on be aware that a scale in Florida is drug paraphernalia it dose not matter what I use it for.

Interesting. I'd have to see the actual legislation before I believed that.

Yeah right!. I would have asked, very nicely, what article of law said that. So in Florida you cant know what things weigh?

I'm not an attorney, but based on what I read, I think there would need to be additional facts/circumstances in addition to mere possession of a scale (without any residue on it of course) for a charge of drug paraphernalia to stick.

Hard to believe. I wonder where you could find out for sure. States Atty.? I suppose that matches and lighters are also suspect, maybe even spoons.

Well if thats drug paraphernalia than as Buddy says matches and lighters must be too. Was the officer young? Sometimes I think some of them are trying to make a name for themselves, the older ones don't care as much about little things it seems.

well after checking (not just fl) this goes on everywhere with alot of court documents!

When asked about
his past experience in making arrests for "digital scales as drug paraphernalia," Officer
Johnson testified that "[j]ust the digital scale is drug paraphernalia."1

I think from now on when I drive to a coin show I am going to put my scale, some small mylar envelopes and a stack of cash on the front seat of my car in case I get stopped....and put the number for a good ACLU attorney on speed dial on my phone.
What a bunch of malarky, having a scale does not make you a criminal.
